Personal mobility, a futuristic mobility mode frequently feat ured in recent news, is widely viewed as a next-generation m obility device that reduces traffic jams and environmental poll ution. However, the legal definition of personal mobility is uncle ar and the regulatory level is not determined, so it poses syste matic challenges, such as accidents. Since personal mobility has become available thanks to techno logical development, it is concerned that it will hinder the techn ological development if it is overly regulated due to safety conc erns. On the other hand, if the regulatory level is set too low, it wouldl infringe upon the rights of pedestrians and other transpo rtation users and cause safety problems. Above all, the legal definition of personal mobility should be c learly defined in order to secure industrial competitiveness led b y new technological developments, and to protect pedestrian righ ts and other transportation users. Therefore, it is urgent to seek ways to secure the safety of personal mobility devices as well a s the safety in its operation. In this regard, this paper clarifies the legal definition of personal mobility and proposes institutional improvements in terms of safety by comparing foreign legislation.

최근 뉴스에 심심치 않게 등장하고 있는 미래형 이동수단인 퍼스널 모빌리티는 교통체증, 환경오염 등을 저감시키는 차세대 이동수단으로 각광받고 있다. 그러나 퍼스널 모빌리티에 대한 법적 정의가 명확하지 않고, 규제수준도 결정되지 않아서 안전사고가 우려되는 등 제도적인 과제를 안고 있다. 퍼스널 모빌리티는 기술발달의 정도에 따라 등장한 것이기 때문에 안전문제 등으로 인하여 과도하게 규제할 경우 기술발달을 저해할 우려가있다. 반면, 규제수준을 너무 낮게 설정하면 보행자와 다른 교통수단 이용자의 권익을 침해하고 안전문제를 초래할 우려가 있다. 새로운 기술발달로 인한 산업경쟁력 확보와 보행자의 보행권, 다른 교통수단 이용자와의 조화를 위해서는 우선 퍼스널 모빌리티의 법적 정의를 명확히 하고, 퍼스널 모빌리티 자체의 안전확보 방안과 퍼스널 모빌리티의 운행상 안전 확보 방안을 모색할 필요가 있다. 본 논문에서는 이러한 관점에서 퍼스널 모빌리티의 법적 정의를 외국의 입법례를 비교하여 정리하고 안전성의 관점에서 제도적 개선방향을제시하고자 하였다.
