This article analyzes the Appellate Body Report on European Union – Anti-Dumping Measures on Biodiesel from Argentina. The dispute relates to anti-dumping measures applied by the European Union (EU) on biodiesel imports from Argentina, as well as a specific provision, namely Article 2(5), second sub-paragraph of the Council Regulation (EC) No. 1225/2009 of 30 November 2009 on protection against dumped imports from countries not members of the European Community. The Appellate Body’s findings have implications for possible disputes relating to the issue of “particular market situation” which is increasingly relied on by traditional users of anti-dumping measures, such as the European Union and the United States. This article aims to explore what implications the different elements of the Appellate Body’s findings will have on similar disputes.
