China has achieved a steep economic growth for about 30 years since its Reform and Opening while it encounters serious problems of environmental pollution. Especially, with the smog phenomenon that occurred in Beijing in 2013 as a momentum, the Chinese government has been preparing environment-related policy and legislation. China has enforced 19 laws in total, 30 specialized administrative regulations declared and enforced by the State Council and about 70 other specialized administrative regulations for the current environmental management. Especially, the environmental protection law amended overall in 2013 shows the present Chinese government's will to strict management and supervision concerning environmental issues. In addition, the Environmental Protection Tax Law of the People's Republic of China dealt by this study in priority is a law enacted for the protection and improvement of the environment, the reduction of the emission of pollutants and the construction of ecological civilization of China, and the same Act mandates enterprises that emit taxable pollutants in the jurisdictional sea area under Chinese administration as well as the areas in China pay environmental protection tax by law and provides the tax base, tax amount, tax cut and collection management, etc. Currently, the number of Korean companies that expanded their business to China was about 3,500. It is expected that the enforcement of the same Act on January 1, 2018 would have a direct impact on Korean companies, and they should thoroughly get ready for this.

중국은 개혁･개방 이후 30여 년간 가파른 경제성장을 이룬 반면 심각한 환경오염 문제에 직면하고 있다. 특히 지난 2013년 발생한 베이징 스모그 현상을 계기로 중국 정부는 환경 관 련 정책 및 법제 등을 마련하고 있다. 중국은 현재 환경 관리를 위해 총 19개의 법률, 국무원 이 공포하여 시행중인 30여개의 전문 행정 법규, 그리고 기타 70여건의 전문 행정 규칙을 시행하고 있다. 이중 2013년에 전면적으로 개정된 환경보호법은 중국 정부의 환경문제에 대한 엄격한 관리･감독의 의지를 보여주고 있다. 본 논문에서 중점적으로 다루고 있는 중국 환경보호세법은 중국의 환경 보호와 개선, 오염 물질 배출 감소 및 생태 문명 건설을 위하여 제정된 법률로서 동 법은 중국내 영역 뿐 아니라 중국 관할 해역에서 과세 오염물을 배출하는 기업에 대해 환 경보호세를 납부해야 할 것을 법률로 정하고 있으며, 이에 따른 과세기준, 납세액, 세금감면, 징수 관리 등을 규정하고 있다. 현재 중국에 진출한 한국기업은 약 3,500여개로 2018년 1월 1일 동 법 시행 이후에는 우리 기업에 직접적인 영향을 끼칠 것으로 예상되는바, 이에 대한 적극적인 대비를 해야 할 것이다.
