The attempt by the National Assembly of Korea to revise the constitution in 2017 came about as a result of the abuse of presidential powers. The installment of bicameralism has also been studied in order to promote decentralization and to achieve a balance between the representation of the population and of the territorial communities Among several models of the upper house, the French system has been chosen as an appropriate model because France is also a Unitary State based on decentralization. Artice 24, paragraph 2, sentence 2 of the French Constitution prescribes that “The Senate shall ensure the representation of the territorial communities of the Republic“. As one might expect, French Senators are representatives of the territorial communities of the Republic as in the following two points. First, French senators are elected by electoral bodies which are composed of counselors elected by Communes, Departments and Regions, and of individuals elected for this specific purpose. Second, Senators work for the free administration which is a special characteristic of French decentralization. As the representative of the territorial communities, the French Senate as a legislative power protects the interests of the territorial communities, for example, by enacting decentralization in the 1982 Act and by modifying the Constitution as regards decentralization in 2003. Artice 39, paragraph 2, sentence 3 stipulates that “Without prejudice to the first paragraph of article 44, Bills primarily dealing with the organisation of territorial communities shall be tabled first in the Senate“. In this article, the Senate could articulate its characteristics as the legislative to enhance decentralization and local autonomy. Artice 61, Paragraph 2 stipulates that the President of the Senate or 60 Senators could refer to the Constitutional Council if, before its promulgation, an Act of Parliament for the decentralization and the territorial communities does not conform to the Constitution. The Senate promotes and advances the interests of the territorial communities with its control functions, such as information missions, reports of group studies and oral and written questions. In 2009, the Senate established a new delegation for decentralization and the territorial communities. This delegation publishes several reports to monitor the situation of decentralization and local autonomy. In light of the current discussions on constitutional revision, it would be desirable to examine in more depth whether this model of Senate could be applied in Korea.

지방분권의 실효성 확보 및 보장의 문제와 국회의원 선거에서의 인구비례대표성을 보완한 지역대표적 성격의 강화문제를 해결하기 위한 논리로 양원제 도입 여부가 논의되고 있다. 연방국가가 아닌 단일국가의 형태를 가지면서 양원제를 채택하고 있는 국가로서는 영국·이태리·스페인·일본·프랑스 등을 들 수 있다. 그러나, 영국·이태리·스페인·일본 등의 국가들에 비해 프랑스는 우리나라와 같이 민주공화국을 기반으로 하고 있을 뿐만 아니라 단체자치를 토대로 한 지방자치를 구현하고 있다는 점에서, 프랑스의 양원제도와 상원에 관한 연구의 필요성이 증대되고 있다. 프랑스 헌법 제14조 3항 2문에서 ‘상원은 공화국 지방자치단체 대표제를 보장한다’라고 규정하고 있다. 프랑스는 약 162,000명 정도에 해당하는 상원의원 선거인단 대의원 선출에서 95%의 대의원이 기초자치단체인 Commune에서 선출되도록 하고 있으며, 선출되는 상원의원은 대부분 지방행정을 직접 담당하고 있다. 또한 상원은 지방분권의 핵심적 내용이라 볼 수 있는 자유로운 행정의 수호자로서 역할을 수행하고 있다는 점에서 지방자치단체 및 지역의 대표기관으로서 지위를 가진다고 할 것이다. 지방자치단체 대표기관으로서의 상원은 지방의 이익을 보호하기 위한 입법기관으로서의 지위를 가지고 있으며, 이러한 측면에서 헌법 제 39조 2항 3문에서는 법률안의 주된 목적이 지방자치단체의 조직에 관한 경우에는 상원에 우선 제출하여 심의를 받도록 규정하고 있다. 또한 지방자치단체와 지방분권에 관련된 법률안에 대하여는 헌법재판소에 사전적 위헌심판 청구권을 행사하여 지방의 이익이 침해당하지 않도록 하고 있다. 나아가 1982년 지방분권법률의 제정이나 2003년 지방자치 헌법개정과 같은 구체적인 입법활동을 통하여 실질적이고 유효한 지방분권이 구현되도록 하고 있다. 나아가 프랑스 상원은 상원 자체의 조사활동이나 지방자치단체 및 지방분권문제 상원 대표부의 활동 등을 통하여 지방분권을 감시하고 조장하는 기관으로서의 역할도 수행하고 있다. 우리나라에서는 양원제에 따른 비효율성을 근거로 하여 도입에 대하여 비판적 입장을 보이고 있지만, 국회의원 선거가 인구비례 대표적 성격을 더욱 강화하고 있으며 지방분권의 실질적 구현도 요망되고 있으므로 지방자치단체 및 지역대표적 성격을 가지는 상원의 신설을 적극적으로 검토하여야 할 것으로 본다.
