The "Cultural Heritage Protection Act" is the basic law that forms the basis of cultural heritage management in Korea. It is a law stipulating the basic principles and rules for the protection and management of cultural heritages. In order for Korean cultural assets to succeed properly in the future, the role of this law is important and it is necessary to establish its status. In order to examine the legal status of the "Cultural Heritage Protection Act", this study focuses on the purpose clause which can grasp the legislative purpose of the law most clearly. Although the amendment has been carried out in the meantime, the amendment of the purpose clause has been rarely carried out, and the reasons for the amendment have been reviewed, and the problems of the Korean legislation have been examined through comparison and review with the Japanese Cultural Heritage Protection Act.

「문화재보호법」은 우리나라 문화재 관리의 근간을 이루는 기본법으로 문화재의 보호와 관리에 관한 기본원칙 및 시행규칙을 규정한 법률이다. 우리나라의 문화재가 올바로 후대에 계승되기 위해서는 동법 의 역할이 중요하며 그 위상을 확실히 확립할 필요가 있다. 「문화재보호법」의 법적인 위상을 고찰하 기 위하여 본 연구에서는 법률의 입법목적을 가장 명확하게 파악할 수 있는 목적조항을 중심으로 살펴 보았다. 동법은 그동안 많은 개정이 시행되었음에도 불구하고 목적조항의 개정은 거의 이루어진 바가 없는데 그 이유가 무엇인지 고찰하고, 일본의 「문화재보호법」과의 비교·검토를 통하여 우리나라 법 령의 문제점을 고찰하였다.
