Korea introduced unskilled foreign workers to the country as a response to alleviate labor shortages in Korea’s 3D industries—a phenomenon brought on due to the country’s rapid economic growth, demand for globalization, and high educational attainment within society. Since then, foreign workers’ labor rights and human rights violation issues have been raised, and this has become a social issue with regards to the treatment of female migrant workers. Issues stem from problems of the legal system and problems of workers’ living and working conditions. In particular, these women are becoming the object of a ‘triple hardship’ as they are ‘women’, ‘foreigners’, and ‘workers’. In some cases, women have been neglected maternity protection, or subjected to sexual harassment and sexual violence. As well, long working hours and living in harsh environments leave them vulnerable to violation of the right to health. From the perspective of labor rights and human rights, this study examines the overall legal system as it pertains to female foreign workers, especially considering that women are subject to complex discrimination. All women have the right to freedom from sexual harassment and sexual violence, and the universal right to maternity protection.

우리나라에서 비전문외국인력의 도입은 급속한 경제성장과 세계화의 요청, 고학력 화로 인한 3D산업에서의 노동력 부족현상을 완화하기 위해 인정되기 시작하였다. 이후 그들의 노동권, 인권침해 문제가 야기되었고, 이는 결혼이주여성의 처우문제와 함께 사회적 문제로 대두되게 되었다. 외국인여성근로자의 노동권 및 인권침해와 관련하여 발생되는 문제는 크게 법제 도상의 문제와 노동 및 생활실태상의 관점에서 제기된다. 특히, 외국인 ‘여성’ 근로자는 ‘외국인’, ‘근로자’가 가지는 전반적인 노동인권문 제와 동시에 ‘여성’이라는 삼중고의 대상이 된다. 여성은 모성보호의 대상이라는 점 과 성희롱 및 성폭력의 대상이 될 수 있으며, 열악한 환경에서의 장시간 노동과 저 급한 생활로 인한 건강권 침해에 취약할 수 있고, 여성노동에 대한 저평가가 존재한 다는 점에서 더욱 그러하다. 본 연구는 이러한 외국인 여성근로자의 처우문제에 초점을 맞추어, 그들의 노동 과 보편적 권리 보장이라는 관점에서 법제도적ㆍ정책적 개선방안을 제시하는 것을 목적으로 한다. 그러기 위해 먼저, 비전문 외국인근로자에 대한 전반적인 법제도를 노동권 및 인권적 관점에서 검토하고, 여성은 고용상 복합차별의 대상이 되고 있다 는 점을 감안하여 성희롱 및 성폭력으로부터 자유로울 수 있는 권리 및 모성보호 등 젠더적인 측면을 세분화하여 검토한다.
