Hazardous health hazards in occupational activities of workers are exposed to harmful substances such as dust, benzene and carcinogens. Unlike other diseases, occupational diseases are exposed to long-term exposure to harmful substances, making it difficult to be recognized as an occupational disease. Also, occupational diseases are difficult to prove causality despite long-term exposure of workers to metals and toxic gases. The symptoms of occupational diseases are similar to the symptoms of general illness, so it is difficult to find them early and it is difficult for employees to personally prove causality. In addition, occupational diseases require long-term treatment due to the toxicity of harmful substances, and even if they are recognized as work-related diseases, compensation level by the Industrial Accident Compensation Insurance Act is low. Therefore, it is necessary to establish special laws for pneumoconiosis such as type of occupational disease, recognition standard, kind of compensation (medical care benefit, disability benefit, special benefit, survivor benefit and intestine expense), application procedure of occupational disease and management of occupational disease.

근로자의 직업활동에서 건강을 위협하는 유해요소에는 분진, 벤젠, 발암물질 등 유해물질에 노출되고 있다. 직업병은 다른 질병과 달리 유해물질에 장기간 노출되어 발병하기 때문에 업무상질병으로 인정받기가 쉽지 않다. 또한 직업병은 근로자가 금 속 및 유독가스에 장기간 노출되었음에도 불구하고 인과관계를 입증하기가 어렵다. 직업병의 증상은 일반적인 질병의 증상과 비슷해 조기에 발견하기가 어렵고, 근로자 가 개인적으로 인과관계를 입증하기도 곤란하다. 또한 직업병은 유해물질의 독성으 로 인하여 장기간의 치료가 필요하고, 업무상 질병으로 인정되더라도 산업재해보상 보험법에 의한 보상수준이 낮은 문제점이 있다. 따라서 진폐증의 사례와 같이 직업 병의 유형과 인정기준, 보상종류(요양급여, 휴업급여, 특별급여, 유족급여 및 장의비등), 직업병의 신청절차, 직업병의 관리방안 등에 대한 특별법을 제정할 필요가 있다.
