Impact of the Transition of Japan's Immigration Policy on the Social Status of Koreans in Japan

The purpose of this paper is to pursue reasons why it is difficult for Koreans in Japan to enhance their social status by reviewing the historical transition of Japan’s immigration policy. Historically, the characteristics of Japan’s immigration policy after the end of the Second World War are twofold. By the mid-1970s, Koreans in Japan were virtually the only targets of immigration control by the Japanese authorities, whereas multinational foreigners have been targeted since the 1980s, particularly after the arrival of refugees from Indochina. Owing to Japan’s harsh immigration policy, Koreans who were residing in Japan by the 1970s had to reconsider their residency in Japan. The immigration policy made it difficult for them to pursue additional social rights, such as a national pension and public housing. Furthermore, even after the conclusion of the Korean-Japanese Normalization Treaty in 1965, the residency of those Koreans who supported North Korea or Chongryeong was still threatened. In other words, they were inevitably regarded as political refugees regardless of her/his will. Since the 1980s, Koreans in Japan have been regarded as a third category in Japan’s social integration policy, that is, they were neither considered Japanese nationals nor were they considered foreigners. Since then, they started obtaining social rights. However, this was achieved by international pressure or gaiatsu and the international human rights framework. In this sense, the Special Permanent Residency Bill of 1991 is important, because it was voluntarily proclaimed by the Japanese authorities for the purpose of securing the legal status of Koreans in Japan. The Bill is also important, because it reflected the historical backgrounds of Korean residency in Japan. This is the reason why Japanese Chauvinists are strongly asserting themselves for the abolishment of the Special Permanent Residency.

본고는 일본 출입국정책의 변화과정을 검토함으로써 그 관리통제의 주된 대상인 재일코리안이 일본에서 어떠한 법적지위와 사회적 위상 속으로 살고 있는지에 대해 논함으로써 이들의 좀처럼 개선되기 어려운 사회적 위상의 원인을 규명하는 것을 목적으로 한다. 해방 후 일본 출입국정책은 재일코리안을 전적으로 대상으로 삼아 제도설계가 이루어진 1970년대까지 시기와 인도차이나난민 정착 후의 외국인 다국적화에의 대응이라는 두 시기로 크게 나눌 수 있다. 이를 재일코리안 입장에서 보면 1970년대까지는 최소한의 체류권조차 불안한 상황에 대한 대처의 시기이며, 그나마도 한국국적 선택 여부라는 정치성향에 따라 일본정부에 의해 달리 취급받고 있었다. 즉 재일코리안은 본인의 의지와 상관없이 정치적 존재라는 점이 부각된 것이다. 1980년대의 외국인 다국적화 상황에서 재이코리안은 일본인도 외국인도 아닌 제3범주로 다루어지기 시작했다. 국제인권 규범이라는 ‘외압’에 일본이 포섭됨에 따른 사회권 획득이 이루어졌고 다문화공생 논의에서도 도외시되었음에도 불구하고 점차 외국인으로서의 지위 개선에서 도움을 받게 되는 등 간접적으로 권리상황이 개선되어갔다. 이런 가운데 1991년에 제정된 특별영주제도는 재일코리안의 법적지위를 항구적으로 안정시키고 정치성향에 따른 차등취급을 없애는 등 일본 출입구정책 중 일본정부가 선제적으로 대응했다는 점에서 획기적인 것이었으며, 이로써 재일코리안은 적어도 체류권 측면에서는 위협을 받지 않게 된 것이다. 특별영주제도가 오늘날 배외주의자들의 최대 공격대상이 되고 있는 것은 이 같은 맥락에서 이해할 수 있을 것이다.
