The purpose of this study is to describe illegal parking and stopping and to provide improvement plans for effective law enforcement. First, the definition, categories, and enforcement process for illegal parking and stopping were explained, as well as related statistics such as total number of cases, amount and collection of penalty, and several problems raised by illegal parking and stopping were also discussed. The study provided two effective law enforcement processes. First, law enforcement officers must be able to regulate violators on site regardless of current five-minute regulation criteria in order to assure pedestrian safety. Second, illegal parking and stopping should be independently controlled from head of local governments. Flexibility of control and decisions of prohibited areas for parking and stopping should be based on the characteristics of each district. As results, public safety can be ensured by preventing various problems such as pedestrian accidents from illegal parking and stopping and quality of life for community residents can be increase by maximization of road traffic conditions.

본 연구는 여러 가지 주차위반들 중에서도 불법주정차를 중심으로 그 실태를 살펴보고 효과적인 법집행을 위한 개선방안 제시를 그 목적으로 하였다. 이를 위해 먼저, 불법주정차의 정의와 불법주정차의 단속항목 및 단속과정에 대해서 살펴본 후, 불법주정차의 실태로서 단속건수와 과태료 부과 및 징수현황에 대해서 살펴보고 불법주정차로 인해 발생하는 여러 가지 문제점들(보행자 및 주정차 차량충돌의 원인, 주거지역과 상업지역 내의 불법 주정차로 인한 피해 확대, 안전정책 실효성과 운전자 인식개선 저해)에 대해서 살펴보았다. 본 연구는 2가지 법집행 제고방안을 제시하는데 첫째, 법률적 측면에서는 현행 단속기준 시간인 5분에 상관없이 현장에서 단속할 수 있어야 한다. 둘째, 단속적 측면에서 단속 시에 일관된 주정차단속이 이루어질 수 있도록 자치단체장으로부터 주정차 단속 업무가 독립적으로 이루어질 수 있도록 보장할 필요가 있으며, 지역적 특성에 맞는 탄력적 단속과 주정차 절대금지구역에 대한 강력한 단속집행이 이루어져야 한다. 그 결과 불법주정차로 인해 발생하는 보행자 사고와 같은 여러 가지 문제들로부터 시민들의 교통안전을 확보할 수 있고 나아가 원활한 도로교통 극대화로 궁극적으로 지역사회시민들의 삶의 질이 향상될 것이다.
