This study aims to examine foreign cases regarding an illegal lottery, devise solutions, and prevent the spread of the illegal lottery in order to prevent the illegal lottery market from being recently extended rapidly via the internet and SNS (Social Network Service). To achieve the goal of this study, this paper figures out domestic and foreign cases and suggests how to use solutions from foreign countries. A lottery has become popular more and more with a longer history than other speculation businesses. Hence, many people use it for play rather than gambling and use various types of lottery such as housing lottery, instant printed lottery, number-selection lottery, sports lottery, and more. Since lotto that is a number-selection lottery with a high dividend rate started to be sold in February, 2002, a lot of men and women of all ages have purchased it. Furthermore, as the tax revenue security became easier due to the success of the lottery, many types of lotteries spring up everywhere. A flood of the lotteries results in a serious addiction phenomenon and becomes a social problem because some people run through all their money. In particular, recently, the number of internet advertisements that lead people to purchase an illegal lottery with a high dividend rate via the internet and SNS (Social Network Service) has increased. Hence, the illegal lottery is more likely to become a serious social issue. As the number of illegal lottery businesses in foreign countries increases, the illegal lottery becomes a serious problem because it is used as a source of funds for a confidence trick and a gang. As for China, an old printed illegal lottery called Yook Hap Chae has been used until now. Thus, the Chinese government positively copes with this. In the United States, the illegal lottery via the internet is particularly severe. Thus, the government shuts down the internet in order to prevent it. Based on these foreign cases, this paper presents a variety of methods to prevent the illegal lottery market that has been gradually spread in South Korea such as blocking of ads via the internet and SNS, blocking of a suspected bank account for foreign illegal lotteries, regulation of the online sales for illegal lotteries, and active responses for printed lottery issuers.

이 연구는 최근 들어 인터넷 및 소셜네트워크(Social Network Service) 등을 통해 급격하게 확장되고 있는 불법복권시장을 차단하기 위하여 외국의 사례를 살펴보고 대응방안을 강구하여 불법복권의 확산을 차단하기 위한 목적을 가진 연구이다. 연구의 목적을 달성하기 위하여 이 연구에서는 국내 사례 및 외국의 사례를 살펴보고 외국의 대응방안을 활용한 방안을 제안하였다. 사행사업 중 복권은 다른 사행산업보다 역사가 깊고 대중화되어 많은 사람들이 사행성의 목적보다는 놀이의 개념으로 이용하고 있으며, 주택복권․즉석식 인쇄복권․번호선택식 복권․스포츠 결과를 예측하는 스포츠복권 등 다양한 유형의 복권을 이용하고 있다. 2002년 2월 높은 배당률을 보이고 있는 번호선택식 복권인 로또가 판매되기 시작하면서 남녀노소를 구분하지 않고 많은 사람들이 구매하기 시작하였으며, 선택식복권의 성공으로 세수확보가 용이해짐에 따라 많은 복권들이 우후죽순처럼 생겨나기 시작하였다. 복권의 난립은 복권에 대한 심각한 중독현상을 보이는 경우가 발생하였으며, 가사를 탕진하는 등의 사회문제로 발전하였다. 특히, 최근 들어 인터넷, 소셜네트워크 등을 이용하여 높은 배당률을 자랑하는 불법복권을 유도하는 광고가 증가하고 있어 불법복권이 심각한 사회문제가 될 가능성이 높아지고 있다. 외국에서는 불법복권 사업이 증가함에 따라 불법복권에 의한 신용사기 및 폭력조직의 자금원으로 활용되는 등의 문제로 인하여 불법복권을 심각하게 다루고 있다. 중국의 경우 육합채라고 불리우는 오래된 인쇄식 불법복권이 현재까지 이용되고 있어 이에 대하여 적극적으로 대응하고 있으며, 미국의 경우 인터넷을 이용한 불법복권이 기승을 부리고 있어 이를 예방하기 위하여 인터넷을 차단하는 등의 방법을 이용하고 있다. 이러한 해외사례를 바탕으로 우리나라에서 점점 확대되고 있는 불법복권시장을 예방하기 위하여 인터넷 및 SNS 등을 이용한 광고차단, 의심되는 해외 불법복권 계좌에 대한 차단, 불법복권에 대한 온라인 판매의 규제 및 인쇄식 복권 발행자에 대한 적극적인 대응 등의 방안을 제시한다.
