This paper examines the current mediation system of disputes in Aggregate Buildings Act(hereinafter ‘the Act’), analyzes causes of low successful rate in that mediations and suggests to reform that system. Aggregate Building Dispute Mediation Committees are made according to the revision in 2012 of the Act. However, in spite of the recent increase in numbers of the disputes, the performance of mediations are disappointing. To boost successful mediation, I suggest that the committee should compel attendance of the administrator and have the power to demand materials concerned in the hands of the parties concerned. In addition, to reflect incremental disputes surrounding environmental problems such as noises between floors, I examine the role of administrator to help resolve disputes and carry out necessary measures. I think that invigorating mediation system rooted in autonomous dispute resolutions is necessary for the Act to stand under the principle of private autonomy, balancing with public interventions.

현재 저조한 실적을 보이고 있는 집합건물법상 분쟁조정제도를 개선하기 위해서는 위 분쟁조정의 실태를 분석하고 그 실적이 저조한 원인을 찾아내어 분쟁조정의 활성화를 위한 방안을 마련하는 것이 필요하다. 필자는 본고에서 최근 집합건물법 개정위원회가 개정안을 마련하는 과정에서 검토한 내용을 소개하면서, 이와 관련된 개인적인 견해를 간략하게 밝혔다. 먼저, 현행법상 합의 성립으로 간주하는 조정의 효력을 재판상 화해와 같은 것으로 끌어올릴 것인지, 아니면 조정의 효력에 대한 현행법의 태도를 유지하면서도 조정가능성을 높이기 위한 ‘조정위원회의 적극적인 개입’수단으로서 당사자 또는 관리인의 출석을 강제하거나 조정위원회에 조사 및 자료제출권을 부여할 것인지를 다루었다. 그리고 분쟁조정의 대상에 소음·진동·악취 등 공동생활과 관련된 분쟁을 포함시키면서 위 분쟁의 해결에서 관리인의 역할을 강화하고, 관리인에게 분쟁해결에 필요한 조치를 취할 의무와 분쟁조정에 필요한 조사권한을 부여할 것인지 등에 관한 내용을 다루었다. 마지막으로 집합건물법이 사적자치의 원칙에 충실한 민사특별법의 지위를 굳히기 위하여 분쟁의 자율적 해결에 기초한 조정제도를 활성화하는 것은 공법적인 행정규제를 최소화하기 위해서라도 필요한 작업이라는 필자의 견해를 밝힘으로써 본고를 마무리하였다.
