Koreans were surviving on an average of 67 dollars a year in the year of 1953. Six decades later, Korea is one of the top five car producers and the eighth-largest trading nation. Thus, Korea was grown up out of export and international trade. We have few natural resources. But the man power and enthusiasm of education of the parents are remarkable in the world. Through these factors we could achieve one trillion dollars trade volume. Internationally fast every countries have export or trade supporting system. We are also making effort to support trade through trade insurance. It is operated by the Korea Trade Insurance Corporation. In former times only the export was supporting object. But now, not only export, but also import is also supporting object. The import is also very important for the improvement of the export. The European Union has its own trade supporting system. But unlawful subsidy is prohibited by international treaty. Therefore the EU has established the concept of marketable risk. The marketable risk is taken over by the civil insurance companies. And the government subsidy is prohibited in that field. Especially the German export credit system is divided by two sectors. One is civil sector, another is governmental sector. The credit insurance company Euler Hermes is operating the export credit insurance according to the trust of the German government. In Germany, the dual system of administrative law and civil contract law is studied by scholars in the field of export credit insurance. The two sectors of administrative law and civil contract law are closely connected. And the constitutional root or background is also important research object. For the improvement of our trade supporting system we should consider foreign examples. The European and German system can give us important suggestions. Through these comparative study we can learn the importance of theoretical study on export credit insurance. And the support of small and midium sized companies through export credit insurance is also very important. For this goal and the effective trade support, the Korea Trade Insurance Corporation should do its best efforts. Then we can achieve our ultimate goal of powerful economic nation in the world without violating international treaty, namely WTO agreements.

우리나라와 같이 천연자원이 부족한 국가에서는 인적자원의 노력을 통한 산업발전과 그에 대한 물품의 수출입이 절대적으로 중요하다. 우리나라 무역보험제도는 그동안 많은 변천을 겪고 또 많은 성장을 이룩하였다. 과거 수출100억불 목표시대에서 이제는 무역 1조 달러 전후를 달성하게 되었다. 무역보험 제도는 국제통상법상 정부보조금 지급 금지에 위배되지 아니하는 방편구로 각 국가가 운용하는 무역진흥제도이다. 따라서 국가마다 특성이 있고 주변국의 실정 등에 의하여서도 영향을 받고 있다. 다만 어느 정도의 공통된 룰이 존재하는 만큼 국제적인 비교고찰이 중요하다. 따라서 우리가 나아갈 시사점을 찾고자 유럽의 무역보험제도와 독일의 무역보험제도를 살펴보는 것도 의미가 있다. 독일의 경우 Euler Hermes사가 민간 보험사이면서도 정부의 수출신용보험업무를 대행하는 기능도 동시에 수행하고 있다. 그리하여 그 회사에서는 상업계정과 정부계정으로 구분이 되어 계리․운용을 하고 있다. 독일의 경우 1990년대 민간 신용보험회사들은 덩치를 키우기 위한 합종연횡을 단행하였다. 이를 통하여 현재 독일에는 3대 민간 신용보험회사들이 건재하고 있다. 그리고 무역보험에 민법과 보험계약법이 적용된다는 점은 우리와 같다. 우리의 경우에도 과거 수출보험에 대하여 일반 민영 보험의 원리가 기본적으로 적용된다고 대법원은 보고 있다. 독일은 유럽과 마찬가지로 2년 이하의 신용위험 및 비상위험을 담보하는 거래로서 시장의 민간 보험회사가 감당할 수 있는 거래를 민간보험사인수위험으로 지정하여 이에 대하여는 정부지원을 금하고 있다. 이는 불법 보조금 지급을 금한다는 취지에서이다. 법적 토대연구를 위하여 독일에서는 행정법과 민사계약법이 접목된 무역보험에 대한 법률관계를 정치하게 연구하고 있다는 점이 특징이다. 우리의 경우에도 국가가 재정지원을 하여 운용하는 무역보험에 대한 헌법적 기초, 행정법적 논의를 추가적으로 하는 것이 필요하다. 즉 국가재정법적 고찰과 일반 민사법적 연구가 같이 진행되어 무역보험에 대한 법리를 정치하게 적용하는 노력이 필요함을 알 수 있다. 수출 내지는 무역으로 성장한 국가가 바로 대한민국이다. 천연자원은 부족하지만 인적자원이 풍부하며 부모들의 강한 교육열이 뒷받침되어 압축적 성장이 가능하였다. 이 때 각종위험으로부터 보호하는 등의 수출진흥정책이 필요하였다. 그를 위하여 과거 수출보험법, 수출보험공사가 존재하였다. 수출은 수입이 뒷받침 되어야 가능하므로 국제적인 추세에 맞추어 2010년 수출보험법을 무역보험법으로, 수출보험공사를 무역보험공사로 개칭하여 무역보험지원을 담당하고 있다. 앞으로도 우리나라가 계속 성장하고 발전하기 위하여는 무역보험에 의한 지원이 필수적으로 요구된다. 따라서 무역보험제도를 확대하고 합리적으로 운용하여야 한다. 또한 대기업지원뿐만 아니라 중소기업에 대한 수출․무역을 지원하는 것에도 더욱 힘을 기울여야 한다.
