This paper analyses the decisions of the Korea Fair Trade Commission on price collusion. It turns out that the price significantly increased when collusion started, but that the price did not decrease significantly at the end the collusion. The result calls for the measure of Korea Fair Trade Commission to bring the actual price decrease after the end of collusion, including administrative fine reflecting the price decrease or monitoring the price changes after the decision. It also turns out the price changes caused by the collusion are quite different among the cases. Considering the characteristic of administrative fine that confiscates illegal profit from collusion, one should take into account the actual price increase in determining the administrative fine.

가격담합과 관련하여 공정거래위원회가 위법하다고 심결한 사례를 분석한 결과, 담합의 시기에는 가격인상 효과가 유의하게 나타난 반면, 담합의 종기에는 가격인하 효과가 전혀 유의하게 나타나지 않았다. 이에 따라 공정거래위원회의 심결이 단순히 담합을 적발하여 과징금을 부과하는 데 그치지 않고 실제적인 가격인하를 유도하도록 방안을 마련하는 것이 필요한 것으로 나타났다. 여기에는 과징금 부과시 가격인하 정도를 반영하는 방안이나 심결 이후 산업환졍 조사 등을 통해 가격동향을 모니터링 하는 방안도 포함될 수 있을 것이다. 또한 분석의 결과, 담합의 시기와 종기에 나타난 가격변화는 품목별로 커다란 차이를 보이는 것으로 나타났다. 이에 따라 불법적인 이득의 환수라는 과징금의 성격을 반영하여 과징금 부과시 담합에 따른 가격인상률을 감안하는 방안도 고려해 볼 수 있을 것이다.
