우리나라는 2000년 아동복지법의 전면개정으로 아동학대 보호체계에 관한 법률적 근거를 마련하였지만, 현재까지 아동학대는 근절되지 않고 지속적으로 증가하였을 뿐만 아니라 중요한 사회문제로 간주되어지고 있다. 이에 정부는 2014년 우리사회 아동학대 예방과 피해아동 보호체계를 정책과제로 설정하여 아동학대에 대한 예방․홍보강화, 조기발견 및 신속한 대응체계 구축, 지역사회 복지자원과의 연계를 통한 아동학대 사후관리서비스 강화와 같이 구체적으로 방안을 제시한 아동학대 종합대책을 발표하였고, 2016년 계속되는 아동학대범죄를 계기로 종합대책에서 제대로 시행되지 않고 있던 아동학대에 대한 신속한 대응과 처벌의 강화, 피해아동에 대한 보호와 지원 및 재학대방지, 생애주기별 아동학대 예방체제강화 등과 같은 아동학대방지 대책을 발표하였다. 정부의 종합대책은 아동학대 대응방식에 관한 접근방법 중 아동학대는 조기개입과 예방사업의 활성화, 가정에 대한 지원을 포함하여 모든 지원은 연속선상에서 있어야 한다고 주장하는 통합적 시스템과 그 맥락을 같이 하는 것으로, 아동과 위험에 초점을 맞추고 아동학대가 발생한 상황에서 아동을 위험으로부터 구출하는 것에 초점을 맞추고 있는 이분법적 시스템과는 차이가 있다. 종합대책과 방지대책을 수립하기 전에는 아동학대 관련기관별 이분법적 시스템과 유사한 대응 방식을 취하였으나, 통합적 시스템을 적용하는 것으로 아동보호체계가 전환되었음도 불구하고, 아동보호체계가 신고조사를 기반으로 한 시스템을 벗어나지 못함으로 인하여 여전히 각 기관별 아동학대 수행체계는 이분법적 시스템을 유지하고 있으며, 특히 경찰의 경우 사전 예방이나 조기개입에 대하여 제한적일 수 밖에 없고, 아동학대 발생시 현장에서도 여러 가지 제약들 때문에 적극적으로 대응하지 못하고 있어 아동학대에 소극적 대응을 할 수 밖에 없는 실정이다. 따라서 현재 우리나라 아동학대보호체계의 통합적 시스템에 따라 경찰에서는 아동학대에 대한 인식전환이 반드시 필요하며, 홍보, 교육, 사전인지를 위한 지역사회경찰활동과 같은 적극적인 아동학대 예방활동 참여, 그리고 반복적이고 고위험성 학대행위에 대한 적극적 대응이 필요하다.
