Presidential candidate guard is much harder than the presidential guard because he has to hold both the voters' votes and the candidate 'safety' at the same time. However, there is no legal provision for the presidential candidate's guard. Therefore, in this paper, I propose a solution for the problem of presidential candidate guard. The problem of the present Korean presidential candidate guard can be compressed to three problems. The first is that there is no clear legal provision for presidential candidates guard. Based on the main personnel guard in the Police Officer's Duty Execution Law, it carries out guard work in accordance with the guard rules. However, this is a problem because it is not clear responsibility among the guard agencies and the chief of the police officer is likely to intervene in arbitrary judgment. Second, the police officers in charge of presidential candidates are lacking in professionalism. Third, there is a lack of awareness of the importance of presidential candidates and the protection of the public. Therefore, in order to prevent the occurrence of harm to presidential candidates First, there should be a clear law for the presidential candidates. In this law, guard, guard period, private guard, and scope of work should be defined. Second, it is necessary to improve the professionalism of the police guard. For this, I think it is necessary to carry out the guard guideline system, integrate the guard department, secure the efficiency of personnel management, and strengthen the guard capability. Third, it is necessary to raise awareness of guard. The presidential candidates, the police officers, and the public should have a higher level of consciousness about guards.

대통령후보자 경호는 유권자 ‘표심’과 후보 ‘안전’이라는 두 마리 토끼를 동시에 잡아야하기에 대통령 경호보다도 훨씬 어렵다. 그러나 대통령후보의 경호에 대해서는 법률규정이 없다. 따라서 이 논문에서는 대통령후보자 경호에 대한 문제점을 도출하여 개선방안을 제시해보고자 한다. 현행 우리나라의 대통령후보자 경호에 대한 문제점은 크게 세 가지 정도로 압축할 수 있다. 첫째는 대통령후보자 경호에 대한 명확한 법률규정이 없다는 것이다. 경찰관직무집행법상의 주요인사 경호를 근거로 하여, 경호규칙에 의거하여 경호업무를 수행하고 있다. 그러나 이는 경호기관간에 책임이 명확하지 않고, 경찰청장의 자의적인 판단이 개입될 가능성이 많아서 문제점이 있다. 둘째, 대통령후보자 경호를 담당하는 경찰관들의 전문성이 부족하다는 것이다. 셋째, 대통령후보자나 국민들의 경호의 중요성에 대한 인식이 부족하다는 것이다. 따라서 대통령후보자에 대한 위해발생을 방지하기 위해서는 첫째, 대통령후보자 경호를 위한 명확한 법률이 제정되어야 할 것이다. 이 법률에서는 경호대상자, 경호기간, 전담경호대, 업무범위 등이 규정되어야 할 것이다. 둘째, 경찰경호의 전문성을 향상시켜야 할 것이다. 이를 위해서 경호경과제의 실시, 경호부서의 통폐합, 인사관리의 효율성 확보, 경호역량의 강화 등이 필요하다고 생각한다. 셋째, 경호의식의 고양이 필요하다. 경호대상자인 대통령후보뿐만이 아니라 경호경찰관 그리고 가장 중요한 국민들의 경호에 대한 의식이 한 차원 더 높아져야 할 것이다.
