In a rapidly changing society, suicide is no longer a personal matter but a social problem. As such, there is a growing need to find a fundamental way to prevent suicide. In recent years, suicide has become a serious social problem, growing not only in overall numbers but also in the number of deaths in the 20s and 30s. This social phenomenon is causing serious problems in connection with suicide incidents in Korean Military, which are currently under conscription. The suicide committed by the soldiers has a great influence on the morale of the army, the maintenance of combat power, and the reliability on the military forces of the people. Further, as the effect of the suicide incidents has a harmful influence on the family and friends, the suicide should not be considered separate problem from social problems. In order to prevent suicide during military service, it is necessary to understand various factors influencing suicide. In addition, suicide should not be regarded as a problem of individual mental health or special environment of the Military. Instead, the suicide should be approached comprehensively with a perception that it is a preventable public health problem. Therefore, in this paper, we first examine the theoretical considerations of the suicide, and then examine the background and factors of suicide during military service in terms of civil society suicides and enlisted soldiers. In addition, examining the suicide prevention approach of the Military, we will study the current suicide prevention activities in the Military. Then, I will examine the relevance between suicide and duty in the military, the suicide of the soldiers, and the liability for damages.

급변하는 사회 속에서 자살은 더 이상 개인의 문제가 아닌 사회적 문제로서 자살예방을 위한 근본적인 방법을 모색해야할 필요성이 높아지고 있다. 최근 수년 동안 자살은 수적인 증가뿐만 아니라 20·30대 사망원인에 있어서 1위를 차지할 정도로 심각한 사회문제로 대두되었다. 이러한 사회적 현상은 현재 징병제를 시행하고 있는 우리나라 군복무중 자살사고와 연계되어 큰 문제를 야기하고 있다. 군에서 발생하는 장병들의 자살은 군 전체의 사기와 전투력 유지, 국민들이 갖는 대군 신뢰도 등에 큰 영향을 준다는 점에서 영향력이 매우 크며, 자살사고의 폐혜는 가족 및 친구들에게 영향을 주므로 사회적 문제와 별개로 구분하여 볼 수 없다. 군복무중 자살을 예방하기 위해서는 우선 자살에 영향을 미치는 다양한 요인들에 대한 이해가 수반되어야 함은 물론 자살을 개인의 정신건강과 군내 특수한 환경의 문제로만 볼 것이 아니라 예방 가능한 공공의 건강문제라는 인식을 갖고 포괄적으로 접근하여야 할 것이다. 본 논문은 자살에 대한 이론적 고찰을 우선 살펴 본 후 군 복무 중 자살배경 및 영향요인을 민간사회 자살양태와 입대 장병의 세대측면에서 살펴보았다. 군복무 중 자살이 단순한 개인적 자유의지에 의한 것인지 아니면 자유의지가 배제된 상황에서 발생한 것인가에 대하여 직무관련성을 검토하였다. 군복무중 자살은 단순히 자유의지에 의한 것이 아니라 선임병 등의 가혹행위 등의 요인에 의해 경우가 많아 이들 자살자에 대한 직무관련성을 통한 손해배상청구가 확대될 필요가 있다. 따라서 본 연구는 군복무중 자살자의 특별한 권력관계에서 발생하는 것으로 개인의 책임을 벗어나 국가의 책임을 통한 피해구제가 이루어져야 한다.
