The hot debate about the lobby legislation is gaining big attention again in Korea, especially after the enactment of ‘Kim Younglan law’. The law is applied to the one-end side of lobby contacts. The lobby law is a setting up a general rule system which is supposed to be applied to the other side of the lobby contact. This paper is attended to propose a set of legislative and institutional elements of the lobby regulation system which is most suitable to the political & regulatory environment in Korea from the international comparative perspective. Chari etc. classified 3 lobby regulatory system –high , medium, and low regulatory system- according to the regulatory intensity determined by major key elements including legal definition of lobbyist and individual registration, electronic filing of lobby data base & public access, systematic disclosure of the lobbying activities, effectiveness of the lobby law enforcement, and revolving door provision. This paper show how the proposed Korean model can be integrating the different view pertaining to the lobby regulation.

한국에서 로비법 제정 여부를 둘러싼 논란이 최근 김영란법 제정과 관련하여 다시 일어나고 있다. 로비법제화는 로비스트가 로비 받는 정부 공직자에게 접촉하여 영향력을 행사하고자 할 때 지켜야 할 기본 규칙을 일반 법규로 정립하는 것을 의미한다. 한국에서 정치인이나 공무원 등 정부 공직자자 정부 외 인사들과의 접촉 과정에서 지켜야 하는 법규는 다양하게 존재한다. 하지만 로비스트로서 활동할 때 의무적으로 지켜야할 법규는 전혀 존재하지 않는다. 로비법제화는 사실상 존재하고 있는 로비활동을 양성화하고, 이를 투명하게 공개함으로써 정치부패를 예방하자는 것이다. 미국이나 캐나다와 같은 고강도 규제시스템으로부터 최근 법제화가 이루어진 영국이나 아일랜드에 이르기까지 로비활동 규제모델은 국가별로 차이가 있다. 이 연구는 국제비교의 관점에서 한국의 현실 상황에 맞추어 가능성과 타당성 측면에서 가장 바람직한 규제 모델이 무엇인지 그 법제화 과정에서 포함되어야 할 주요 내용을 제시하는데 그 연구 목표가 있다.
