The year in 2016 has been the hottest one since the creation of the Earth. This record renewed highest value for the third consecutive year. According to the announcement of NASA(National Aeronautics and Space Administration), the average temperature last year stood at 14.8℃. Compared to the average in the 20th century, it is the numerical value that is higher by 0.94℃. It is being expected that this abnormally high temperature will lead to making it double in carbon dioxide concentration when it comes to the year in 2050. Even in our country, the year in 2016 was the hottest one with recording 13.6℃ in the annual average temperature. The influence in this climate change is being added not only to a person's health, but also to the national policy and the industrial world. WEF(World Economic Forum) is predicting that a major global risk in the future will be climate change. Also, the climate fluctuation is being regarded as a forecast factor that will decide on a global growth path. Climate is a flow of the atmosphere given seeing naturally, and is the circulation of life based on the sea level, and has an economic ripple effect. Climate is not a criterion any more that divides it into torrid, temperate, and frigid zone. An environmental change caused by a climate variation can be considered to be the very thing in a human being's right to life and environmental right. Owing to this, the climate fluctuation requires various approaches such as society, culture, politics, and economy beyond the dimension of greenhouse gas. America, which is emitting a lot of greenhouse gases in the whole world, has a partial responsibility relevant to climate change. What merely reduces greenhouse gases is not the best for preventing climate variation, but can be regarded as a minimal effort. The liberal ideology and the capitalism, which dominate American society, are restricting the opposition in the industrial world and society to the federal government's effort for cutting greenhouse gases. Coping with the limitation to the federal government's effort for reducing greenhouse gases related to the climate variation, the civic groups and some state(州) governments arranged relevant legislation themselves and are demanding legislation to the federal government. Also, diverse climate-change lawsuits are being filed. The purpose of this study is to examine the judgment in the Supreme Court of the United States pertinent to a lawsuit against climate variation that is being newly raised. In addition, the aim is to figure out the fluctuation and the formation in the policy related to climate change by the federal government following the judgment.

2016년은 지구의 평균온도가 가장 높았던 해이다. 미국 항공우주국은 2016년 평균온도가 섭씨 14.8도였다고 발표하였다. 이러한 이상 고온현상이 40년 이상 지속되면 이산화탄소 농도가 현재의 2배가 될 것이라는 예측이 나오고 있다. 이러한 기후변화는 사람의 건강뿐만 아니라 국가의 정책과 산업계에 미치는 영향이 가중되고 있다. 세계경제포럼은 미래의 주요한 글로벌 리스크를 기후변화로 예측하고 있다. 또한 기후변화는 세계 성장 경로를 결정할 예상요인으로 보고 있다. 자연적으로 보면 기후는 대기의 흐름이고, 해수면의 기준으로 생명의 순환이자 경제적 파급력을 가지고 있다. 기후는 더 이상 열대, 온대, 한대를 나누는 기준이 아니다. 기후변화에 의한 환경의 변화는 인간의 생명권과 환경권의 자체라고 볼 수 있다. 이 때문에 기후변화는 온실가스 차원을 넘어서 사회, 문화, 정치, 경제 등 다양한 접근이 필요하다. 전 세계에서 많은 온실가스를 배출하고 있는 미국은 기후변화에 관련된 부분적인 책임이 있다. 단순하게 온실가스를 배출을 감축하는 것만으로 기후변화를 예방하기 위한 최선은 아니지만, 최소한의 노력이라고 볼 수 있다. 미국 사회를 지배하는 자유이념과 자본주의는 연방정부의 온실가스 감축노력에 산업계와 사회적 반발의 논리로 적용하고 있다. 연방정부의 기후변화에 관련된 온실가스 감축 노력의 한계에 대응하여 시민단체와 일부 주(州) 정부에서는 관련된 입법을 자체적으로 마련하고 연방행정기관에 입법을 촉구하고 있다. 또한 다양한 기후변화 소송을 제기하고 있다. 본 논문에서는 새롭게 제기되고 있는 기후변화소송과 관련된 미국 연방대법원 판결을 검토하고자 한다. 또한 판결 이후 연방정부의 기후변화 관련 정책의 변동과 형성에 대하여 검토하고자 한다.
