The latest issue regarding the legal standards of Self-Defence raises the need to identify the criteria for dividing ‘Self-defence(Criminal Act Article 21(1))’ which can be justified, ‘Excessive Self-Defence(Criminal Act Article 21(2))’ which can be mitigated arbitrarily and ‘Excessive Self-Defence(Criminal Act Article 21(3))’ which shall not be punishable. Firstly, in order to be recognized as Self-Defence, there should be minimum balance of legal interests which is socially valid and reasonable infringement on the choice of menas and methods. In judging these issues, some particular aspects need to be reflected in certain situations, such as violations of illegal use of governmental authority, violations from burglary and such. If such reasonableness is not recognized, then the concerned circumstance should be examined whether fair expectability of legal conduct cannot be acknowledgeable because of anxiety or fear amount to exempting responsibility. However, if this is not feasible, it is necessary to determine whether exemption of responsibility and mitigation or remission of sentence would be acceptable according to the determination on a certain policy. In particular, special psychological state is concerned in a case of repeated domestic violence.

최근의 정당방위 기준과 관련한 논란은 위법성이 조각되는 정당방위(형법 제21조 제1항)와 형이 임의적으로 감면되는 과잉방위(형법 제21조 제2항), 처벌되지 않는 과잉방위(형법 제21조 제3항) 및 위법성이 그대로 인정되는 범죄행위의 구별에 관한 기준을 모색할 필요성을 제기한다. 우선, 정당방위가 인정되기 위해서는 사회적 타당성의 관점에서 최소한의 법익 균형성과 수단 및 방법 선택에 관한 침해의 상당성이 인정되어야 한다. 이 때 불법한 공권력 행사에 의한 침해, 사적 공간인 주거 침입을 수반한 침해 등의 경우에는 상황적 특수성이 고려되어야 한다. 상당성이 인정되지 않는다면 다음으로는 책임을 소멸시킬 정도의 불안, 공포 등으로 기대가능성이 인정될 수 없는 상황인지 검토하여야 한다. 그러나 이러한 정도에 이르지 않는 경우에도 책임이 감경되고 일정한 정책적 판단에 따라 형의 감경 또는 면제가 인정될 수 있는 사안인지 판단하여야 한다. 대표적으로 가정폭력이나 학대 등의 지속적 침해와 지휘, 감독 관계에 있는 자에 의한 침해 등에 대해서는 방위자의 특수한 심리상태가 고려되어야 한다. 이러한 단계적 검토 없이 ‘사회통념상 용인될 수 없어 정당방위나 과잉방위에 해당하지 않는다’는 식의 판단은 지양되어야 할 것이다.
