This article looks into current pre-validity examining system for mega sports event like olympics, asian games or world cup games held in Korea and then tries to suggest how to improve the system in terms of legal and institutional improvement. Current pre-validity examining system mainly focuses on economic inducement effect of the mega sports on regional and national economy. This economic effect is usually gauged by inter industry analysis and tends to be exaggerated than the real economic effect of the game. The other non economic effects caused by the game, like how much the game enhanced the brand value of a region or Korea, are evaluated but not much priority is given to. Alternatives to improve current system can be classified into 3 categories; short-term, mid-term, and long-term. In short-term, under current system, we can open to the public the result of comparison between pre-game (expected) and post-game (real) economic effects of the mega sports event. Building D/B regarding mega sports event can also be an alternative. In mid-term, amending current legal system to provide institutional alternatives; review and approval of regional council regarding the pre-validity examination (during bidding phase), prohibiting the increase of total expenditure in principle (during the game period), comprehensive evaluation and its announcement of the game (after game). In long-term, legislation of international sports exchange enhancement law can be a fundamental solution for introducing all the possible improvements including alternatives suggested above as well as establishing a relevant independent institution.

이 글은 올림픽, 아시안게임, 월드컵 등 대형국제경기대회를 유치할 때 실시하는 사전타당 성 제도의 현황과 문제점을 살펴보고 그에 대한 법적, 제도적 개선방안을 모색한다. 현행 사 전 타당성 조사는 50억 원 이상의 총사업비가 소요되는 국제경기대회를 대상으로 하며 주로 대회가 개최지역과 국가에 가져올 경제적 효과를 산업연관모형에 따라 분석하는 경제성 분 석에 치중하고 있다. 대회 이후 경기장 시설의 사후활용이나 대회가 지역과 국가에 미치는 이미지 제고효과 등 비경제적 영향은 분석대상으로 삼고 있긴 하지만 크게 주목하지 않는 것이 사실이다. 경제성 분석도 대개 대회 개최에 따른 경제적 유발효과로 표현되는데 대개 는 실제 체감하는 것 보다 과장되어 나타나는 것이 일반적이다. 또한 지방자치단체장 혹은 지역 정치인들의 업적과시를 위한 수단 등 대회 외적인 요인으로 대형국제경기대회가 유치 되는 경우가 많아, 대회 유치를 위한 사전타당성 조사가 효율적으로 실시되어야 할 필요성 이 더 커진다. 개선방안으로는 우선 단기적으로 현행제도 하에서 사전타당성 조사결과와 사 후결과를 비교해 공개하도록 하고, 현행 국제경기대회 관련 위원회 운영을 내실화 하며, 국 제경기대회 지식정보 서비스 시스템을 구축하는 방안을 모색할 수 있다. 중기적으로는 국제 경기대회 지원법을 개정하여 국제경기대회 유치단계, 개최단계, 종료 이후 단계에서 각각 사 전타당성 조사결과의 지방의회 의결 요구, 총사업비 증액의 원칙적 금지, 대회개최 결과에 대한 종합적 평가 및 고시 실시 등을 생각해 볼 수 있다. 보다 근본적으로는 국제체육교류 진흥법을 제정하여 위에 제시한 개선안들을 포함하여 국제체육교류 진흥을 활성화하기 위한 독립적인 기구를 창설하는 방안을 제시할 수 있다.
