This study aims to point out structural limitations of the Prior Consultations on Examination of Factors Influencing Disasters based on the Countermeasures Against Natural Disaster Act and suggest the measures of enhancing disaster mitigation. This system reviews both structural and non-structural measures to mitigate the effects of seven types of disasters (river; heavy rain, etc.). Structural measures include any physical construction to reduce possible impacts of hazards and the application of engineering techniques or technology to achieve hazard resistance and resilience in structures or systems. Non-structural measures do not involve physical construction processes but use knowledge, practice or agreement to reduce disaster impacts, particularly through policies and laws, public awareness enhancement, training and education. Considering that structural measures tend to fail in case of excessive disasters surpassing a designed frequency, both structural and non-structural measures should be augmented against unexpected disasters.

본 논문은 자연재해대책법에 근거를 둔 사전재해영향성검토협의의 구조적인 대책의 한계를 지적하고 비구조적인 대책의 활성화를 통해 재해저감 대책의 실효성 증진 방안을 제안한 것이다. 사전재해영향성검토협의 제도에서는 하천, 호우, 사면, 지반, 연안, 바람, 기타 등 7가지의 재해영향성에 대비한 구조적 대책과 비구조적 대책을 검토하고 있다. 구조적 대책은 예상가능한 재해영향을 줄이기 위한 물리적인 시설 또는 재해영향의 저감과 구조물과 시스템의 회복에 필요한 공학적 기술을 활용하는 것으로 대표적인 사례는 댐, 하천제방, 방조제, 내진구조물, 대피소 등이 있다. 비구조적 대책은 물리적 시설을 활용하지 않고 재해영향을 줄이기 위한 사회적 동의 및 실천과 지식의 활용을 말하며 대표적으로 도시건축법, 토지이용규제, 평가, 위험정보 전달, 공공의식 강화 프로그램 등이다. 설계빈도를 상회하는 재해가 발생하면 구조적인 대책의 한계는 분명히 발생한다. 따라서 사전재해영향성검토협의에서는 예상하지 못한 재해에 대비하기 위해서 구조적인 대책과 더불어 비구조적인 대책을 증진해야 할 것이다.
