The purpose of this study is both to find whether the infringement of non-pecuniary legal interests including life, body, honor of citizens due to legal exercise of police authority is indemnified and to propose the solutions whether to aid and how to remedy. Police Indemnification program for pecuniary legal interests due to legal Exercise of Police Authority hae been implemented since 2014. But, that Police indemnification for infringement of non-pecuniary legal interests was not legalized at that time. Because, some people were concerned about the abuse of police authority. To resolve this incompleteness of the current Police Indemnification program, the study is conducted whether the theory can be applied in our legal system. In addition, it is reviewed both which system other country have for police Indemnification program and what is the best solution. Also. the need to introduce police Police Indemnification program is mentioned through the case study. In its final analysis, this study propose that we need to introduce the Police Indemnification program for non-pecuniary legal interests through the revision Act on Performance of Duties by Police Officers.

이 연구의 목적은 적법한 경찰권 행사로 인해 국민의 생명ㆍ신체 등 비재산적 법익에 대한침해가 발생한 경우에 현행 법 체제 하에서 그 권리구제가 가능한지 여부와 불가능한 경우에 이를 어떻게 해결할지에 대한 해결방안을 제시하는데 있다. 2014년도에 시행된 개정 경찰관직무집행법에 의해 적법한 경찰권행사로 인해 재산상 손해가 발생한 경우에 국가가 이를 보상해주는 경찰손실보상제도가 마련되었으나, 그보다 더 중한 손해라 할 수 있는 생명ㆍ신체ㆍ명예 등 비재산적 법익 침해에 대해서는 경찰권남용 우려 등을 이유로 함께 입법화되지 못해 아직 그에 대한 법적 보상제도는 마련되지 못하고 있다. 이 연구는 현행 경찰보상제도의 위와 같은 불완전성을 극복하고자, 그 해결방안으로 현행 법체제하에서 희생보상이론이 도입가능한지를 각종 이론 및 판례 등을 연구해 검토함과 동시에 외국의 사례는 어떠한지와 그것들 중 어떤 것이 우리 법 현실에서 가장 타당한지를 문헌 등을 통하여 연구하다. 아울러, 관련 사건들에 대한 판례내용에 대한 분석을 통해 경찰희생보상제도 도입필요성과 그로 인해 국민과 경찰에 어떠한 도움을 줄 수 있는지도 함께 검토한다. 이러한 연구들을 통해 현행 우리 법 체제 하에서는 경찰관직무집행법 재개정을 통해서 경찰희생보상제도의 도입을 입법론적으로 해결함이 바람직하고, 이는 국민권익보호 및 경찰발전에 큰 도움이 될 것임을 제시한다.
