Common Commercial Policy is the part in which EU customs alliance and market unification have extended internationally while being one of the policy decision areas having the greatest transnational characteristics in the EU system. The origin of common commercial policy is the ‘Treaty of Rome’ of 1957 and was used for arbitrating the trade relations between European Economic Community and third world countries for the most part. EU has approved the Common Commercial Policy as one of principles in arbitrating the official international relations at the ‘Treaty of Lisbon’ of 2007. This study has specifically analyzed the role which the legal basis of EU Common Commercial Policy, policy decision process, related economic trading field and Common Commercial Policy have on international relations. First of all, the ‘exclusive policy decision ability’ of Common Commercial Policy is not a legally absolute one. Although some new trading issues (for instance, service trading or intellectual property rights, etc) are endlessly being included in the Common Commercial Policy as the expansion of oversea trade and free international trade of EU has accelerated, the legal basis for such issues has generally gone through the process of changing from “common policy decision ability” to “exclusive policy decision ability”. Therefore, the “exclusive policy decision ability” of Common Commercial Policy is a legal concept which is relatively obscure and develops dynamically. This study has classified the policy decision process of Common Commercial Policy into 4 different types from each other based on the details related to the EU Common Commercial Policy. First, the subject promoting Common Commercial Policy is the European Commission and the subject making decisions is the European Council in the aspect of arbitrating international trade relations between EU member nations while the decisions are made by majority through voting. Second, the subject promoting Common Commercial Policy is the profit making group by business types within EU while the trading investigation of the committee and final decision by the board of directors are included in the policy decision making process. Third, in case of negotiating trades and concluding trade agreement between EU and third world countries or related international organizations, the Europe board of directors must delegate the authority to the committee first, the Europe committee is responsible for reporting the specific trade agreement process periodically to the board of directors and the negotiated results are voted based on the details related to the trade agreement by the board of directors. Fourth, the policy decision making in the field of trade related to the “common policy decision ability” of EU must be agreed on unanimously by the member nations while each member nations of EU must give common approval. Based on the details above, the chapter 3 of this study has performed an in‐depth analysis on “intergovernmental” tendencies shown in the EU Common Commercial Policy. This study has described 3 types of important changes that have occurred in the detail aspect of the Common Commercial Policy for the last several years. First, while the emphasis of interest toward the Common Commercial Policy was at the redistribution of dispersed trades in the past, it has currently developed into intensive industrial growth and protection. Second, the detail related to the Common Commercial Policy has extended to the non customs trade barrier of domestic policy from merely reducing the customs duty. Third, the subject for handling the Common Commercial Policy has extended to the trade diplomatic policy having many policy objectives (protection of human rights or development issues, etc) from pure international trade issues. According to this study, the general arbitration ability between profit making groups of each business type, between EU organizations and between each member nations within EU are gradually getting restrictions. Therefore, the “intergovernmental” tendency will lead the future objectives of Common Commercial Policy within the “transnational” policy decision making framework. The conclusion of this study has described the fact that development and transition of EU Common Commercial Policy were shown as terminable combination between “transnational” and “intergovernmental” cooperation. The EU unification theory which is currently forming a mainstream toward such special conditions is unable to come up with adequate interpretation. The EU Common Commercial Policy has currently presented another new theme toward the correction and development of EU unification theory.

공동상업정책(Common Commercial Policy)은 EU 관세동맹과 시장 통일이 대외적으로 확 장된 부분이며 EU 체계에서 가장 초국가적 성격을 갖는 정책결정 분야 중 하나이다. 공동상업정책의 발 단은 1957년 ‘로마조약’이며 초기에는 주로 유럽경제공동체(EEC)와 제3국가간의 무역 관계를 조정하는 데 활용되었다. EU는 반세기 동안의 발전과정을 거쳐 2007년의 ‘리스본조약’에서 공동상업정책을 공식 적인 대외관계를 조정하는 원칙 중 하나로 인정하였다. 본 연구는 EU공동상업정책의 법률적 기초, 정책결정 과정, 관련 경제무역 분야 및 공동상업정책이 EU 의 대외 관계에 미치는 역할에 대해 구체적으로 분석하였다. 우선, 공동상업정책의 “배타적 정책결정 능 력”은 법률적으로 절대적인 것은 아니다. EU의 대외무역 확대와 국제무역 자유화가 가속화됨에 따라 일 부 새로운 무역문제(예를 들어 서비스 무역, 지적재산권 등)가 끊임없이 공동상업정책에 포함되고 있기 는 하지만 이러한 문제들의 법률 기초는 일반적으로 “공동 정책결정 능력”에서 “배타적 정책결정 능력” 으로 변화하는 과정을 거쳤다. 따라서 공동상업정책의 “배타적 정책결정 능력”은 상대적으로 모호하고 동태적으로 발전하는 법률 개념이다. 본 연구는 EU공동상업정책과 관련된 내용에 근거하여 공동상업정책의 정책결정 과정을 4개의 서로 다 른 유형으로 분류하였다. 첫째, EU 회원국 국가 간의 대외 무역관계를 조정하는 측면에서 공동상업정책 의 발기 주체는 유럽위원회(European Commission)이고 결정 주체는 유럽이사회(European Council)이 며 투표를 통해 다수결로 결정한다. 둘째, EU와 제3국간의 무역질서를 규정하는 측면에서 공동상업정책 의 발기 주체는 EU 내부의 업종별 이익집단이며 정책결정 과정에는 위원회의 무역조사와 이사회의 최 종 결정이 포함된다. 셋째, EU와 제3국 또는 관련 국제조직 간에 무역협상을 하고 무역협정을 체결할 경우, 유럽이사회는 우선 위원회에 권한을 위임해야 하며 구체적인 무역협상과정은 유럽위원회가 책임지고 정기적으로 이사회에 보고하며 협상결과는 이사회에서 무역협정과 관련된 내용에 근거하여 투표를 한다. 넷째, EU의 "공동 정책결정 능력”과 관련된 무역 분야에서의 정책결정은 반드시 회원국이 만장일 치로 동의해야 하며 EU 각 회원국이 공동으로 승인해야 한다. 상기 내용을 바탕으로 본 연구 제Ⅲ장에서는 EU공동상업정책에서 나타난 “정부간” 경향에 대해 심도 있게 분석하였다. 본 연구에서는 최근 몇 연간 공동상업정책의 내용면에서 발생한 3가지 중요한 변화에 대해 기술하였다. 첫째, 공동상업정책의 관심의 중점이 과거에는 분산된 무역 재분배에 있었으나 현재는 집중적 산업발전 과 보호로 발전하였다. 둘째, 공동상업정책과 관련된 내용은 단순히 관세를 줄이는 것으로부터 국내 정 책의 비관세 무역장벽 문제로 확대되었다. 셋째, 공동무역정책의 취급 대상은 순수한 대외무역 문제에서 여러 정책 목표(인권보호, 발전문제 등)를 가지는 무역 외교정책으로 확대되었다. 본 연구에 의하면 공 동상업정책 내용의 집중화, 국내화와 외교화에 따라, EU 내부에서의 각 업종의 이익 집단 간, EU기구 간 및 각 회원국 간의 전반적인 조정능력이 점점 제약을 받고 있다. 따라서 “정부간” 경향은 “초국가”적 정책결정 틀 안에서 공동상업정책의 미래 방향을 주도할 것이다. 본 연구의 마지막에서는 EU공동상업정책의 발전과 변천은 “초국가”와 “정부간” 협조의 유기적인 결합 으로 나타난 것에 대해 기술하였다. 이러한 특수 현상에 대하여 현재 주류를 이루고 있는 EU 단일화이 론은 충분한 해석을 내놓지 못하고 있다. EU공동상업정책은 현재의 EU 단일화이론의 수정과 발전에 하 나의 새로운 과제를 제시하였다.
