This paper is to review the legal issues concerning the characteristics of marine traffic. It is said that judicial precedents relating to criminal negligence in marine traffic consider only the navigation regulations compliance and results. but it's a misunderstanding. In the criminal negligence in marine traffic, the same review process as general criminal negligence should be applied. Also characteristics of marine traffic ought to be reflected in the judgement on the breach of objective duty of care, in concrete circumstance. Characteristics of marine traffic, such as the uncertainty of seaway, the lack of immediacy and promptness, the variability of marine environment, the difficulty of maintaining maneuverability, the difficulty of identifying the accident cause. These raise the objective duty of care. It would be difficult to apply the principle of reliance to maritime traffic accident in that the social environment condition are not prepared sufficiently. Due to the characteristics of marine traffic, Negligent Co-Perpetration is needed.

이 논문에서는 해상교통과실범에서 해상교통의 특수성에 대한 취급과 판단의 쟁점에 대해서 살펴보았다. 해상교통의 특수성이란 항로의 불명확성, 선박의 특성에 기인한 예측곤란성, 자연환경의 영향 등을 말한다. 이러한 해상교통의 특수성은 해상교통과실범의 객관적 주의의무위반을 판단하는 과정에서 구체적 상황과 관련하여 고려될 수 있다. 또한 대법원은 해상교통과실의 판단에 있어서 오로지 해상교통법규위반과 결과만을 고려한다고 비판된다. 그러나 이는 오해라고 생각된다. 대법원도 해상교통의 특수성을 객관적 주의의무의 판단에서 고려하고 있다. 다만 이 경우 해상교통의 특수성은 육상교통보다는 주의의무를 높이는 방향으로 작용하는 것으로 해석하고 있다. 해상교통과실범의 주의의무를 제한하는 신뢰의 원칙은 원칙적용을 위한 객관적 요건을 갖추고 있지 못하므로 적용되지 않는다. 해상교통의 특수성으로 인해 공동의 주의의무를 인정하는 것이 보다 수월하고, 조직적 무책임을 방지하기 위해서 해상교통과실범의 공동정범을 인정할 수 있다고 생각한다.
