Act on Indemnification and Remedy for Environmental P ollution Damage, made in December 2014 has been in forc e since 1. January 2016. The aim of the Act is fast and s ufficient remedy for a party who suffered damage. For thi s, the Act provides, among others, strict liability of an ow ner of a facility, presumption of causation, obligation to in sure environmental liability, claim to information. This Ac t can be assessed as a landmark of environmental law his tory in that it set liability issues to rights and provides r emedial system profoundly. In addition, in July 2016, the enforcement ordinance containing a number of sensitive m atters such as mandatory environmental liability insuranc e, which is a sensitive part of the Act, has received a lot of attention. However, the process of law making was not easy. To succeed, it is also important to enact the system well. In this regards, continuous and careful attention should be p ayed to still unsolved issues, In this paper, I will study about the the legislative background of the Law Concerning Liability and Remedies fo r Damage Based on Environmental Pollution and the legisl ative process, and present the overall directiion of the fu ture.

2014년 12월 31일 제정된 「환경오염피해 배상책임 및 구제 에 관한 법률」이 2016년 1월 1일부로 시행되었다. 동법은 환경 오염피해에 대한 배상책임을 명확히 하고, 피해자의 입증부담을 경감하는 등 실효적인 방법으로 피해자를 구제하고자 하며, 환경 오염피해로부터 신속하면서도 공정하게 피해자를 구제하고자 것이 주된 목적이다. 주요내용으로는 환경오염에 대한 사업자의 무과실 책임, 인과관계의 추정과 정보청구권, 배상책임의 보장을 위한 책 임보험의 의무화, 정부에 의한 환경오염피해 보상제도인 구제급여 등 환경오염피해에 대한 구제를 위한 적극적인 내용이 입법되었 다. 뿐만 아니라 2016년 7월에는 동법의 민감한 부분인 환경책임 보험의 의무화 등의 민감한 사항이 다수 담겨있는 시행령이 시행 되어 뜨거운 관심을 받기도 하였다. 환경오염피해에 대해서 적극적인 구제를 위한 새로운 입법적 시도였다는 평가의 이면에는 아직 세심하게 규정되어 있지 않은 아쉬운 부분들을 발견할 수 있다. 본고에서는 「환경오염피해 배상책임 및 구제에 관한 법률」 의 입법배경과 입법과정서부터 동법률의 문제점 및 개선방안과, 하위법령의 특징 및 문제점을 통한 개선방안을 도출하고, 앞으로 「환경오염피해 배상책임 및 구제에 관한 법률」이 나아가야 할 방향을 전반적으로 제시하고자 한다.
