Terrorism has changed in various ways with certain motives and purpose, it has been increased steadily. A need for discussion of terrorism has been raised all over the world. Through active discussions, states have established concept of terrorism in the country and enacted laws such as anti-terrorism act. According to these flows, discussions of terrorism and anti-terrorism laws began in Korea. During the debate, the chairman of the National Assembly passed a bill of anti-terrorism act, claiming that we are in a state of national emergency under threat of terrorism at this time. And his Bill was approved. However, I think the anti-terrorism act has been passed without sufficient discussion and there will be a lot of gaps. In this paper, We will study about the concept of terrorism, analyze the problems of the anti-terrorism act and consider whether to replace the anti-terrorism act with the existing system.

테러는 특정한 동기와 목적을 가지고 다양한 양상으로 변화하며 그 횟 수가 꾸준히 증가했다. 이에 따라 세계 각국에서 테러에 대한 논의의 필 요성이 제기되었다. 각국에서는 활발한 논의를 통해 국가 내의 상황에 맞게 주체적으로 테러 개념에 대해 정립하고 테러방지법과 같은 법률을 제정했다. 이러한 흐름에 맞추어 국내에서도 테러에 및 테러방지법에 대 한 논의가 시작되었다. 이런 토의 과정 중 지난 19대 국회의 국회의장이 당시 대한민국이 테러에 위협받는 국가비상사태에 처해있음을 주장하며 테러방지법안을 직권 상정했다. 그리고 그 법안이 통과됨에 따라 국민보 호와 공공안전을 위한 테러방지법(이하 테러방지법)이 제정되었다. 그러 나 필자는 이 테러방지법은 충분한 토의가 이루어지지 않은 상태에서 통 과된 법안으로, 미흡한 부분이 다수 존재할 것이라고 보았고, 이에 초점 을 맞추었다. 본 논문은 테러의 개념이 국내․국제적으로 어떻게 정립되 어 왔는지 살펴보고, 변화하는 테러의 양상을 짚어보고 있다. 또한 국가 비상사태의 주장에 의해 상정된 테러방지법의 문제점을 분석한다. 그리 고 국내에 미리 갖추어져 있던 체계가 테러방지법을 대체할 수는 없는지 고찰하고 있다.
