A building has been embedded in our daily life, embodying evil as well as good. While safe buildings may increase utilities by providing a stable life space, they may concurrently threaten a person’s life through collapse. Although a building is closely related to our life, our current legislations pay little attention to the legal definition of it. Especially, neither the Civil Act nor Registration of Real Estate Act provides any definition of buildings, even if they are designed to mainly deal with transactions of properties including buildings. When considering the significant impact of natural disaster on buildings in theses days, shaping the contour of a building implies for establishing appropriate building regulations. In other words, defining a building should precede devising regulatory policies for securing safety in building. In this light, it is necessary to develop an interpretive device for incorporating safety values into the definition of a building or at least regulating the transactions of buildings in the market.

건물은 우리의 일상에 포함된 존재로서 편익과 해악을 모두 안고 있다. 안전한 건물은 인간에게 안정적인 생활공간을 제공함으로써 많은 편익을 향유케 하지만, 안전성이 결여된 건물은 인간의 생존을 위협함으로써 공포와 재앙을 불러일으킨다. 이렇듯 우리의 생활은 건물로부터 시작하여 건물에서 끝난다고 보아도 과언이 아닌데, 정작 우리의 법제는 그러한 건물의 개념에 대하여 많은 관심을 두고 있지 않다. 특히 건물을 직접적으로 다루고 있는 민법이나 부동산등기법에서는 건물의 개념을 명문으로 규정하고 있지 않다. 건물의 개념이 어느 정도 그 윤곽을 드러내어야 건물의 안전성 확보 방안도 다각적으로 검토될 수 있을 것이다. 즉, 재난에 대응한 건물의 안전성 확보방안을 구체적으로 다루기 이전에, 그러한 방안들이 우리의 법제에서 적절히 조응할 수 있도록 그 이론적 기초를 제공하는 것도 매우 중요하다고 생각한다. 이러한 취지에서 이 글은 현행법상의 건물개념에 대해 살펴보고, 그러한 건물개념의 해석론을 통해 안전성의 가치와의 관계를 분석하였다.
