In recent years, with the theoretical and practical discussions of restorative justice came a turning point in the aim of corrections. Major alterations are then realized in the methods of corrections. In this article I asked ethically what the inner characteristics of restorative justice are, and I attempted to propose that the question should be answered through the relational ethics. That is, my idea must be the following proposition that the restorative justice has the nature of relational ethics. When the meaning of restoration in corrections deals with the restoration of the relation of an assailant and a victim, it is necessary to consider a philosophical insight of relation. Discussing the correctional ethics so far I restricted the realized place of relation just in the frontline of corrections, namely in the detention or prison. But the changes of place should be enlarged if the restorative justice is the aim and method of corrections. Nevertheless the approaches of relational ethics can be applied no matter what the changes of place are. In a way I can confirm that the arguments of restorative justice reinforce the significance of the approach of the relational ethics. For the discussion in the 1st chapter I observed that the relational approach more needed for the restorative justice. In the 2nd chapter I looked at the importance of autonomy of prisoner’s body and his relation with the others, using concepts of Lee Baik Chul’s ‘inner and outer of prison space’ and Han Young Sun’s ‘deprivation and restoration.’ In the 3rd and 4th chapters, going into details of Charles Colson and Howard Zehr’s restorative justice, I reconfirmed the relational ethics must be essential in the restorative justice. In the 5th chapter I tried to show that the responsibility ethics of Emmanuel Levinas could deepen the present arguments of the restorative justice. I finally suggested the essence of restorative justice must be on the line of enlargement of relational ethics.

최근 국내 교정학계는 교정의 회복적 정의 또는 사법에 의한 이론적이고 실천적인 논의를 통해 새로운 전기를 맞이하고 있다. 그에 따라 교정 방법에도 많은 변화가 이루어져 왔다. 이 글에서는 회복적 정의가 갖는 내적 특성이 무엇인가라는 물음을 윤리적으로 풀어보고자 했고 논자는 그것을 관계윤리라는 관점에서 접근하는 것이 바람직하다는 사실을 제시하고자 했다. 즉 “회복적 정의는 관계 윤리적 특성을 갖는다.”는 명제에 대한 주장이다. 교정에서 회복의 의미가 가해자와 피해자의 관계 복원을 중점 테제로 다루는 한, 관계가 무엇인가라는 물음에 대한 철학적 통찰은 무엇보다 필요하기 때문이다. 논자는 지금껏 교정윤리를 논의해오면서 관계가 실현되는 공간을 교정 현장에 제한했다. 즉 교도관과 재소자가 만나는 구치소나 교도소라는 공간이었다. 그러나 회복적 정의를 교정의 목적과 방법으로 삼는다면 공간의 변화가 확장되는 장점이 있다. 그럼에도 관계 윤리적 접근은 공간의 변화에 상관없이 그대로 적용될 수 있으며, 어떤 면에서는 회복적 정의가 이러한 관계 윤리적 접근의 중요성을 더 강화시키는 면이 있음을 확인할 수 있었다. 이 논의를 위해 1장에서는 교정뿐만 아니라 사법 일반에서 회복적 정의에는 관계 윤리적 접근이 더 많이 요구될 수 있다는 사실에 주목했고, 2장에서는 몸의 자율성과 관계의 중요성을 교도소의 안과 밖, 박탈과 회복의 개념을 각각 제시한 이백철과 한영선의 주장을 함께 살펴보았다. 3장과 4장에서는 찰스 콜슨과 하워드 제어의 회복적 정의에 대한 논의에 관계윤리의 특성은 본질적이다는 사실을 재확인했다. 5장에서는 레비나스의 책임 중심의 정의관이 지금의 회복적 정의에 대한 논의를 심화시킬 수 있음을 보여주고자 했다. 마지막으로 회복적 정의의 핵심은 관계윤리 확장의 연속선상에 있어야 한다는 사실을 재확인하고자 했다.
