독일의 나고야의정서상 접근 및 이익 공유(ABS) 체계 분석과 시사점

Analysis on the Nagoya Protocol-related ABS Regime in Germany and Implications for Korea

Unlike usually other user countries, Germany as a country with little natural resources has positively corresponded to the international regime for Access and Benefit-Sharing(ABS). It signed the Convention on Biological Diversity(CBD) in 1992 and ratified it in 1993. Germany also hosted CBD-COP9 in Bonn, in 2008. And it signed the Nagoya Protocol in 2011 and ratified it and adopted the Act Implementing the Obligations under the Nagoya Protocol and Transposing Regulation 511/2014/EU(Gesetz zur Umsetzung der Verpflichtungen nach dem Nagoya-Protokoll, zur Durchführung der Verordnung 511/2014/EU und zur Änderung des Patentgesetzes sowie zur Änderung des Umweltauditgesetzes) in 2016. According to the German ABS Law, the Federal Ministry for the Environment, Nature Conservation, Building and Nuclear Safety is empowered to regulate the details of enforcement by means of a statutory instrument which shall not require the consent of the Bundesrat, in agreement with the Federal Ministry of Health, the Federal Ministry of Food and Agriculture, the Federal Ministry of Education and Research and the Federal Ministry for Economic Affairs and Energy, where this is necessary for the transposition of Regulation 511/2014/EU and Implementing Regulation 2015/1866/EU. The German ABS Law, for the Prior Informed Consent(PIC), provides that access to genetic resources in Germany is basically not restricted, unless legal exceptions apply. And according to the principle of freedom of contract, the German government has expressed that the government might be obligated to make sure that a Mutually Agreed Terms(MAT) exists, but could not evaluate or enforce its content. Germany just supports the due diligence principle for compliance of the EU Regulation on ABS. And according to Section 4(Artikel 1 § 4) of the German ABS Law, the regulatory offence may be sanctioned with an administrative fine of up to fifty thousand Euro by the administrative authority, the Federal Agency for Nature Conservation(BfN). By the way, Germany need to modify deregulated some rules under the German ABS Law based on the reciprocity of international society and for the purpose and objective of the Nagoya Protocol including conservation of biological diversity and sustainable use besides benefit-sharing. For example, according to Section 3(Artikel 1 § 3) of the German ABS Law, recipients of research funding that is related to the use of genetic resources and associated traditional knowledge under Article 7 of the EU ABS Regulation, are obliged to declare that they will proceed with due diligence as required by Article 4 of the EU ABS Regulation. However, Section 34a first sentence of the German Patent Act requires that the patent application is to include information on the geographical origin of such material, if known. This shall not prejudice the examination of applications or the validity of rights arising from granted patents. The disclosure of origin procedure is therefore a voluntary measure. In this regard, Korea need to be careful for the countermeasures as a user country involved in Regulatory Approaches for the compliance of the Nagoya Protocol.

보통 이용국의 입장인 경우 나고야의정서에 대한 대응이 미온적이나, 독일은 적은 천연자원 보유의 이용국 입장이면서도 접근 및 이익 공유(ABS)에 대한 국제질서에 적극적으로 대응하여 왔다. 독일은 생물다양성협약(CBD)에 1992년 서명한 후 1993년 비준하였으며, 2008년에는 본(Bonn)에서 생물다양성협약(CBD) 제9차 당사국총회(COP)를 개최한 바 있다. 그리고 독일은 2011년 나고야의정서에 서명하였으며, 2016년 동 의정서에 비준하고 동 의정서 및 동 의정서 관련 EU 규칙 511/2014의 국내이행을 위한 법률(Gesetz zur Umsetzung der Verpflichtungen nach dem Nagoya-Protokoll, zur Durchführung der Verordnung 511/2014/EU und zur Änderung des Patentgesetzes sowie zur Änderung des Umweltauditgesetzes)을 채택하였다. 연방의 환경자연보호건설핵안전부(BMUB)는 국가연락기관이며, 독일에서의 나고야의정서 접근 및 이익 공유(ABS)이행을 위한 국가정책수립을 담당하는 부처로서, 연방보건부, 연방식품농업부, 연방연구교육부, 연방경제에너지부 등의 관계부처와 합의하에 관련 업무를 수행한다. 국가책임기관인 연방자연보존청(BfN)은 환경자연보호건설핵안전부(BMUB)의 부속기관으로서의 역할을 수행한다. 독일은 ABS 연방법 제1-2조(Artikel 1 § 2)에 의하면, ‘법적 예외 적용을 제외’하고는, 이용자 입장을 견지하여 현재 독일에서 ‘유전자원에 대한 접근’은 ‘제한’되지 않는다. 그리고 독일 정부는 사전통보승인(PIC)에 관하여 소극적 규제 태도를 취하는 것과 마찬가지로, 계약 자유의 원칙에 따라 상호합의조건(MAT)의 내용에 대해서도 ‘강요’하거나 ‘평가’를 할 수는 없고, 단지 계약(MAT)의 존재 유무에 대해 보장할 의무만 있다는 견해를 표명했다. 우리나라 유전자원법 제11조도 상호합의조건(MAT)이 의무사항이 아닌 당사자 상호간의 ‘협의사항’인 바, 보다 적극적 규제 태도를 취하여 환경보호라는 나고야의정서의 목적 및 취지를 살릴 수 있도록 할 필요가 있어 보인다. 그리고 ABS 연방법 제1-4조(Artikel 1 § 4)는 의무위반시 연방자연보존청(BfN)에 의한 최고 5만 유로의 벌금을 규정하고 있다. 그리고 ABS 연방법안 제4조상의 범죄란, ① 규칙 511/2014 제7조 2항(최종 상품 개발단계)상의 적절주의의무 신고, ② 규칙 511/2014 제4조 3항상의 ABS 법률준수에 관한 국제이행의무준수증명서에 관한 의무를 위반하는 경우를 말한다. 우리나라 유전자원법도 제9조와 제28조에서 의무위반시 처벌에 관하여 규정하고 있으나, 이는 외국인 중심으로 벌칙을 규정하여 내외국에 대한 차별적 소지가 있으며, 이용자의 이해를 지나치게 고려하여 환경보호의 측면이 미약할 수 있어 개선이 필요하다고 볼 수 있다. 그런데, 독일의 경우 이용자 규율이 완화되어 있으나, 국제사회의 상호주의에 입각하여 그리고 나고야의정서의 목적과 취지에 입각하여 이익 공유 이외에 생물다양성보전, 지속가능한 이용을 위하여 개선할 필요성도 있어 보인다. 예를 들면, 연방 ABS법 제1-3조(Artikel 1 § 3)에 따라, 연구자금의 수령자들은 EU 규칙 511/2014 제4조의 ‘적절주의의무’에 따라 이용자로서 신중하게 연구자금을 사용해야 한다. 그런데 독일 특허법 제34a조 1단에 따라 특허 신청은 출처공개를 포함해야 하나, 이는 ‘특허신청의 심사’ 또는 ‘승인된 특허로부터 발생하는 유효한 권리’를 침해하지는 않는다. 따라서 이 ‘출처공개절차’는 출처정보를 공개제공하지 않아도 ‘제재’가 없기 때문에 분명 ‘자발적인’ 공개조치에 해당된다. 이용국 입장인 우리나라도 유전자원 연구자금수령인의 특허신청시 출처정보공개를 기밀상 영업비밀로 표기하는 경우 적절주의의무 이행 판단에서 고려할 수 있을 것이다. 이처럼 우리나라도 나고야의정서의 이행의무준수 규율방식과 관련하여 이와 같은 점과 환경보호를 고려하여 이용국 입장으로서 주의 깊게 대응책을 마련해야 할 것이다.
