Proper consideration of ‘legitimate objectives’ in the text of TBT agreement may reconcile regulatory autonomy of the Member state and free trade, and also achieve the sensible balance between these values. In order to discuss this issue, this paper firstly discusses the relationship between TBT and GATT Agreement, and then it analyses the roles of legitimate objectives, and the manner of its interpretation and application in the TBT Agreement. Finally, this paper examine the Australian Tobacco Act case by applying these analyses. There are indeed no conflicts occurred in both Agreements, and thus, the measure at issues could be covered under both Agreements. Since legitimate objectives are considered in times of ‘less favourable treatment’ consideration under the Non-discrimination, the existence of legitimacy of the regulatory purpose is necessary and the measure should be applied in an even-handed manner. Even-handedness here could be considered as a proxy for a necessary test, and we need to examine whether there are less discriminatory alternatives in times of even-handedness analysis. In determining whether the measure is more trade-restrictive than necessary to fulfil that objective, the measures’ actual and qualitative contribution to the objective is needed rather than quantitative. Finally, It is likely to find that the Australian Tobacco Act is not inconsistent, and it refers that consideration of legitimate objectives may justify the Member state’s right of regulation properly while seeking free trade goals. In other words, genuine and causal relationship between legitimate objectives and means is an essential element in achieving a balance between regulatory autonomy and free trade values.

TBT협정에서는 ‘정당한 목적’의 적절한 해석과 적용은 회원국의 정당한 규제 권한과 자유무역 사이의 균형을 도모할 수 있는 효과적인 방안이 될 수 있다. 이를 위하여 본고에서는 먼저 TBT협정과 GATT협정의 관계를 논의하였고 이를 바탕으로 TBT협정의 주요 원칙 내 ‘정당한 목적’의 역할과 고려방식에 대한 분석을 진행하여, 실제 호주 담배 단순포장법 사례에 이를 적용하여 보았다. 내국민대우 원칙과 불필요한 무역장벽 금지 규정에 있어서의 기술규정이 추구하는 정당한 목적 역할과 고려방식에 대한 분석을 하였다. GATT협정과 TBT협정은 사실상 충돌이 발생하지 아니하며, 해당 조치에 양 협정이 모두 적용될 수 있음을 재확인하였다. 비차별주의에 있어서의 ‘정당한 목적’은 ‘불리한 대우’ 여부 판단에 고려되어 지는데, 이때 이러한 정당한 목적의 존재뿐만 아니라, 그러한 목적 달성을 위해 해당 조치가 공평하게 이루어졌는지를 살펴보아야 한다. ‘공평한’ 운용이라는 것은 ‘필요성’의 원칙과 연결되며, 덜 차별적인 대안 여부가 이를 판단하는데 도움을 줄 수 있다. 또한 불필요한 무역 장벽 금지의 원칙은 정당한 목적을 달성하기 위한 해당 조치의 실질적인 기여 정도가 고려되어진다. 이러한 분석을 통해 해당 조치와 ‘정당한 목적’ 사이의 진정한 관계는 회원국의 규제 권한과 무역자유화 사이의 균형을 적절하게 달성하는데 필요 요소임을 확인할 수 있다. 즉 정당한 목적뿐만 아니라 이를 위한 해당 조치의 공평한 운용과 정당한 목적 달성 여부의 질적인 평가는 회원국의 규제 권한 행사의 정당화에 매우 중요하다. 이러한 TBT협정의 해석 및 적용의 결과 호주의 담배 단순포장법은 TBT협정의 비차별주의와 불필요한 무역장벽 금지의 원칙을 위반하지 아니한 것으로 평가될 수 있을 것이다.
