The heinous crime is constantly occurring and the public's anxiety is growing. It is doubtful whether this anxiety is based on accurate facts about the occurrence of crime. The purpose of this study is to examine whether the people are exaggeratingly assuming the occurrence of cruel crime, what is the cause of the exaggeration, and how to solve the problem. In recent years, the term "heinous crime" has been frequently used in the media, but the concept of heinous crime has been used without legal or academic grounds. This does not allow direct statistical analysis of heinous crimes. Therefore, in this study, we can not directly analyze the occurrence of heinous crime, and estimate the occurrence of heinous crime through the occurrence of violent crimes and brutal crimes similar to heinous crimes. As a result, analysis of official statistics showed that there was no evidence to prove that the number of crime increases because the incidence of related crime is decreasing markedly. Nevertheless, in order to find out the cause of perceived increase in 'heinous crime', we tried to confirm the influence of the media, which is known to affect the crime rate estimation of the general public. To do this, 75 criminal offenses reported in the media over the last 10 years were selected to analyze crime reporting behavior. As a result, the number of reports due to the surge of media has increased, and specific and sensational reports of crimes have been confirmed by the intensification of competition among the media, and psychologically inferred the process in which such media reporting causes the 'over-estimation phenomenon' . To overcome this, it is necessary to clarify the concept and category of 'heinous crime' at the police level and to provide accurate data. In addition, efforts should be made to establish 'heinous crime reporting guidelines' with the media so that the cruelty of crime does not be over-portrayed. In terms of criminal policy, tailored countermeasures such as heavy penalties, enhanced management of criminals, isolation and treatment support are required depending on the type of "heinous crime".

범행수법이 잔인하고 혹독한 ‘잔혹 범죄’가 지속적으로 발생하고 있다. 이로 인해국민들의 불안감은 더해가고 있는데, 이러한 불안감이 잔혹범죄의 발생에 관한 정확한 실상에 기초하고 있는지는 의문이다. 본 연구에서는 잔혹범죄의 발생에 대해서 국민들이 과장되게 추정하고 있는 것은 아닌지, 과장 추정을 하고 있다면 그 원인은무엇인지, 그리고 이러한 문제에 대한 해결방안이 무엇인지를 확인하고자 하였다. 최근 들어 언론에서 ‘잔혹 범죄’라는 용어를 사용하는 경우가 빈번해지고 있지만, 정작 잔혹범죄의 개념은 법률이나 학문적인 근거가 없이 사용되고 있어 조작적인 정의를 내리는데도 어려움이 있다. 이로 인해 잔혹 범죄에 대한 직접적인 통계 분석이가능하지 않았다. 따라서 본 연구에서는 잔혹범죄의 발생추이를 직접적으로 분석하지못하고 잔혹범죄와 유사한 강력범죄, 흉악범죄 등의 발생추이를 통해서 잔혹범죄의발생실태를 추정하였다. 그 결과 공식통계를 분석하면 관련 범죄의 발생은 뚜렷한 감소추세를 보이고 있기 때문에 잔혹범죄가 증가한다는 것을 입증할 근거가 없었다. 그럼에도 불구하고 ‘잔혹 범죄’가 증가하고 있다고 인식하게 되는 원인을 찾기 위해서 일반인의 범죄율 추정에 영향을 미치는 것으로 알려져 있는 언론매체의 영향을확인하고자 하였다. 이를 위해 지난 10년 간 언론에서 보도된 75건의 잔혹범죄를 선정하여 범죄보도 행태를 분석하였다. 그 결과 언론 매체의 급증으로 인한 보도횟수의증가, 언론사간 경쟁격화에 따른 범죄의 구체적이고 선정적인 보도가 확인되었고, 이러한 언론보도 행태가 ‘과대추정현상’을 유발하는 과정을 심리학적으로 추론하였다. 잔혹범죄에 대한 과대추정 현상을 극복하기 위해서는 경찰차원에서 ‘잔혹 범죄’의개념과 범주를 보다 명확히 하고, 정확한 자료를 제공할 필요가 있다. 또한 범죄의잔혹성이 과도하게 부각되지 않도록 언론사와 함께 ‘잔혹 범죄 보도 가이드라인’을마련하는 등의 노력이 필요하다. 형사정책적 측면에서는 ‘잔혹 범죄’의 유형에 따라가중처벌, 우범자 관리의 강화, 격리·치료지원 등 맞춤형 대책이 요구된다.
