Provisions for Chinse Supreme People’s Court concerning the trial of disputes over independent guarantees adopted on July 7, 2016 came into effect as of December 1, 2016. These provisions have the force of the law even if they are not legislated by Chinse Congress. URDG 758 and UN Convention on independent guarantee and standby letter are reflected in these regulations. If the beneficiary presents the complying presentation, the guarantor shall pay the beneficiary despite the applicant has fulfilled his obligation. However, if independent guarantee fraud shall be found by the court, the court shall issue a ruling to suspend payment under independent guarantee. Chinese court shall rule in writing within forty-eight hours upon its acceptance of the suspension payment application. If the applicant fails to initiate a court litigation or arbitration procedure in relation to independent guarantee fraud dispute according to the law within thirty days after the ruling for the payment suspension, the court shall revoke the injunction. The People’s Court of the domicile of the guarantor, under which the payment is requested to be suspended shall have jurisdiction over the independent guarantee fraud dispute.

중국 최고인민법원은 2016년에 독립보증 분쟁 소송에 관한 규정을 제정하여 시행하고 있다. 이 규정은 중국 의회가 제정하지는 않았지만 법률과 동일한 효력을 가지고 있으며, 국제상업회의소가 제정한 청구보증통일규칙과 독립보증에 대한 UN협약을 상당부분 반영하고 있다. 독립보증은 기초거래와 독립적이어서 보증신청인의 의무이행 여부와 관계없이 수익자가 일치하는 지급청구를 하면 보증인은 대금을 지급할 의무가 있다. 그러나 수익자의 사기가 매우 중대하면, 법원은 보증신청인의 신청에 따라 보증인에게 대금지급을 금지하는 가처분을 내린다. 중국 규정에 따르면 대금지급금지 가처분 신청을 받았을 때 인민법원은 48시간 이내에 결정을 내려야 한다. 보증신청인이 대금지급금지 가처분 결정 후 30일 이내에 법률에 따라 독립보증 사기 분쟁에 관련된 소송 또는 중재절차를 시작하지 않는다면 인민법원은 대금지급금지 가처분을 철회한다. 대금지급금지 가처분의 재판관할은 보증서에 명시된 것과 관계없이 보증인 소재지의 법원이 된다.
