나고야의정서와 유전자원 관련 특허 : 한국 교역에 미치는 영향

In 1993, Convention on Biological Diversity(CBD) is signed and took effect to prevent so called ‘tragedy of commons’ because there has been no future-oriented management and no effective control on biological genetic resources. The CBD has three goals such as conserving biological diversity, sustainable usages of element of biological diversity, and fair and equal distribution of benefits from using genetic resources. A concrete strategy to achieve these goals is “Access to genetic resources and Benefit-Sharing(ABS)”. The basic principles(or ground rules) of the ABS have been proposed by the CBD, afterwards those principles are materialized and agreed throughout Bonn Guidelines on ABS on April 2002 and Nagoya Protocol on October 2010. According to Nagoya Protocol, it is necessary to acquire the prior informed consent for approaching the genetic resources of each country, and the profits generated by the use of them should be shared with the countries providing with the resources. Moreover, there are countries that prepared the standard form of contract with the special regulation regarding the attribution of patent rights; there also are countries which have prepared the legislative measures for specifying the sources of the genetic resources when applying patents. Thus, if the domestic companies which regard the patents related with the genetic resources as important do not comply with the compulsory duties, it would be difficult for them to secure patents properly. Also, the interested parties of the providing countries would continuously raise questions to the domestic companies, so that the international trade may be inhibited. In this situation, it is necessary to conduct the research for preparing the related systems, in terms of the patent law; in addition to this, the domestic companies should establish the management strategies by understanding the approach toward the genetic resources and the profit sharing system which are not against Nagoya Protocol. And then, these kinds of efforts and researches should be made and conducted together for the successful fulfillment of Nagoya Protocol and the protection of the domestic industries.

생물유전자원에 대한 효과적인 통제나 미래지향적인 관리가 거의 이루어지지 않아 소위 ‘공유지의 비극(tragedy of commons)'을 초래할 위험이 있다는 인식을 함께 하여 1993년 생물다양성협약(Convention on Biological Diversity, CBD)이 체결·발효되었다. 생물다양성협약은 생물다양성의 보존, 생물다양성 구성요소의 지속가능한 이용, 유전자원의 이용으로부터 발생되는 이익의 공정하고 공평한 분배 등 세 가지 요소를 기본목표로 하고 있으며, 이러한 목표를 달성하기 위한 구체적인 전략이 ‘유전자원에 대한 접근과 이익공유(ABS) 방식'이다. 생물다양성협약에 의해 기본원칙이 제시되고 그 이후 2002년 4월의 ‘본 가이드라인’과 2010년 10월의 나고야의정서에서 구체적인 실현방안이 논의·합의되었는데, 나고야의정서는 지난 2014년 10월에 발효가 되었다. 나고야의정서에 따라 각국 소재 유전자원에 접근하기 위해서는 사전통보승인을 받아야 하고 그 이용으로부터 발생하는 이익을 제공국과 공유하여야 한다. 또한 유전자원 관련 특허의 권리귀속에 대해 특별규정을 둔 표준계약서를 마련한 국가들도 있으며, 특허출원시 유전자원의 출처를 명시하도록 입법적 조치를 한 국가들도 있다. 따라서 유전자원 관련 특허를 중시하는 국내 기업들이 이러한 제반 의무를 준수하지 않으면 특허를 제대로 확보하지 못하고 또한 제공국의 이해관계자들로부터 지속적인 문제 제기를 당하여 국제 교역에 막대한 지장을 초래할 수 있다. 이러한 상황에서 특허법적 측면에서는 관련 제도 정비를 위한 연구를 심도있게 진행하고 이와 더불어 국내 기업들은 나고야의정서에 저촉되지 않는 유전자원에의 접근 및 이익공유 체계를 숙지하여 경영 전략을 반영할 필요가 있다. 그리고 나고야의정서의 성공적인 이행과 국내 산업의 보호를 위해 이러한 노력과 연구가 병행되어 진행되어야 할 것이다.
