Since its revision of franchise law on August 2013, Korea Fair Trade Commission(KFTC) continually enforces harsh regulations on unfair practices of Korean franchise industry. The authors insist that under this unfavorable regulatory environment it is desirable for franchisors and their trade associations(e.g., Korea Franchise Association) to adopt immediately the ethical management for the franchise system. This study provides a theoretical and managerial ground for this argument emphasizing the positive consequences of ethical management on the performance of franchise business. The authors examine the diverse meanings of ‘good faith’ in franchising, a core concept in ethical management, and suggest that Korean franchisors and their associations should establish their own code of ethics reflecting the key elements contained in the ethical codes of other advanced countries.

2013 8월에 이루어진 가맹사업법 개정 이후 공정거래위원회의 프랜차이징에 대한 강력한 규제가 이루어지고 있다. 저자들은 이러한 규제환경 하에서 가맹본부나 그 사업자단체가 윤리경영을 조속히 실 천하는 것이 가맹본부-가맹점 관계에 있어 바람직한 정책 방향임을 강조하고 있다. 이 논문은 이러한 주장의 이론적·실무적 근거로 가맹사업에서의 윤리경영이 경영성과에 미치는 긍정적 효과를 강조하고 있다. 이와 관련 이 논문은 윤리경영의 핵심요소인 ‘신의성실’의 의미를 다양한 각도에서 소개하고 있으 며, 구체적인 윤리경영의 실천방안으로 주요 선진국의 윤리강령이 내포하고 있는 핵심요소를 반영하여 우리나라 고유의 윤리강령을 제정할 것을 제안하고 있다.
