Since President Lee Myung-bak in a nationally televised speech marking the 65th Liberation Day urged to pay attention to the values of a fair society, to make a fair society became a goal of Lee government. Lee said, "in a fair society (1) equal opportunities are given to everyone (2) encourage the values of individual freedom and uniqueness, diligence and creativity (3) other opportunities are given to those who are left behind." But to ask whether a society fair is to ask how it distributes income and wealth, duties and rights, powers and opportunities. The central question is what are the principles of fairness. This article will argue that 'rule of law' is essential for 'a fair society'.

이명박 대통령이 2010년 광복절 경축사에서 ‘공정한 사회’를 언급하면 서, 공정한 사회는 국정 철학으로 자리 잡고 정부 정책의 원리가 되었다. 이 대통령은 공정한 사회를 (1) 출발과 과정에서 공평한 기회를 주고 (2) 개인의 자유와 개성, 근면과 창의를 장려하고 (3) 패자에게 또 다른 기회 를 주는 사회라고 설명하였다. 그러나 공정한 사회는 복합적인 의미를 가지고 있어 다양하게 이해되고 있다. 이 글은 공정성은 수입과 부, 의무와 권리, 권력과 기회와 같은 사 회의 기본 가치의 분배 방식과 밀접한 연관이 있다는 전제 위에서 공정성의 핵심은 ‘법의 지배’에 있다고 주장 한다.
