This article uses American law as a framework for discussing a jurisprudence that seeks to express equal concern towards the competing claims of religious freedom and sexual autonomy. It has three main parts. In part I, this articles tries to define the rights at issue in the cultural war between the religious right and LGBTQ advocates, with particular attention to the distinction US jurisprudence creates between the absolute right to embrace a religious or sexual identity and the more contingent right to enact those identities in social spaces and have them accorded social recognition. Part II argues that the adoption by US courts of a contingent rights paradigm has created vulnerabilities on both sides of the culture war, raising the stakes of rights jurisprudence and making the social recognition of each group dependent on the marginalization of the competing group. In part III, this article proposes a deliberative communitarian approach to balancing the claims of religious and LGBTQ groups as an alternative to the individual rights approach of the US. It uses the KCC decisions in the conscientious objector and military sodomy cases to explore how this alternative could be implemented in practice in Korea.

본 논문은 미국법 체계를 통하여 종교의 자유와 성적 자기결정권 사이의 균형을 도모하는 법학을 논하고자 한다. 본문은 크게 세 부분으로 구성되어 있다. Part I에서는 종교의 자유와 LGBTQ 지지자 간의 문화전쟁에서 문제가 되는 권리들을 정의하고자 한다. 특히 미국법 체계가 종교적 또는 성적 정체성에 관한 절대적 권리와 그 정체성을 사회적으로 확립하고 사회적 승인이 부여되는 보다 불확정적 권리를 규정하는 방식의 차이에 대하여 주목한다. Part II에서는 미국 법원에서 불확정적 권리 패러다임을 받아들인 것이 권리에 대한 의존도가 높아지고 각 입장의 사회적 승인이 다른 입장의 소외에 의존하도록 만들었다는 점에서 오히려 문화전쟁의 양 입장 모두에 대한 취약점을 만들었다고 주장하고자 한다. Part III에서는 개인의 권리 측면에서 이 문제를 바라보는 미국식 접근에 대한 대안으로 공동체주의적 관점을 제시하며 종교와 LGBTQ 그룹의 주장간의 조화를 도모하고자 한다. 본 논문은 양심적 병역 거부와 군대 내 동성애에 관한 한국 헌법재판소의 판결을 통하여 이러한 대안적 접근이 한국에서 어떻게 실현될 수 있는지 연구하고자 한다.
