Intellectual property law purports to protect intellectual creation balancing creator's private interest and user's public interest. However, intellectual property law has focused on expanding its application and strength of protection. It has not given much attention to relevance or influence with human rights. Regardless of its less attention, intellectual property rights and human rights are related with each other and such relationship was recognized in 1948 Universal Declaration of Human Rights and 1976 International Covenant on Economic, Social and Cultural Rights. Recently, protection of indigenous people under WIPO and TRIPs confirm such relationship. Now, it is well recognized that patent is related with public health problem and farmer's rights. However, it is not recognized that other intellectual property areas such as trademark and copyright are related with human rights as well. Recent Washington Redskins case is one good example to show how trademark protection influences to human rights. Copyright has been thought to have more human rights aspects comparing to patent which mainly considers functionality of invention. However, even copyrights consider human rights from the creator's perspective and users, especially users from less developed countries, are not considered. Technical measurement to protect creators and right holders can block access by users from less developed countries to works and cause serious human rights issues. Therefore, it is time to review overall intellectual property law from human rights perspective. So far, intellectual property law has taken into account of right holders and users only to accomplish its purpose. Now, it must expand its consideration beyond users into less protected human being.

인간의 정신적 창작물을 지적재산권으로서 보호해야 한다는 것은 대부분의 현대국가에서 인정되고 있는 원리이다. 그러나 지적재산권의 보호는 절대적인 것이 아니며 창작자의 보호는 이용의 활성화를 통한 사회 발전이라는 공익과의 적절한 균형 속에서만 이루어질 수 있다. 지적재산권의 공익적 측면은 보건, 교육 등 다양한 관점에서 논의될 수 있다. 그 중에서 이 논문에서는 지적재산권과 인권이 전혀 무관한 권리가 아니며 서로 상관성을 가진 권리라는 점에 논의의 초점을 맞추었다. 세계인권선언에서는 창작자의 창작물에 대한 권리가 인권으로서 보호될 뿐만 아니라 창작자 이외의 모든 사람이 이를 향유할 수 있는 권리도 인권으로 규정하고 있다. 그러므로 지적재산에 대한 재산권만이 아니라 그 이용자의 보호도 인권의 범위 안에 포함된다고 할 수 있다. 이런 관점에서 지적재산권을 살펴보면 의약품 특허의 강제실시권, 종자권, 상표의 부등록사유, 저작인격권 등이 지적재산권의 인권보호적 측면을 다루고 있다고 할 수 있다. 그러나 상표의 경우 부등록사유 규정에도 불구하고 인권침해적 표장이 등록될 가능성을 완전히 배제할 수 없으며, 저작인격권은 저작자의 인격만을 보호하고자 할 뿐 저작물이용자의 인권은 고려하고 있지 않다. 현재 상황에서는 그 출발점이라고 할 수 있는 지적재산권이 인권과 상관성을 갖고 있는지 여부에 대해서도 많은 논란이 제기되고 있다. 그러나 분명 지적재산권은 인권보호와 상관성을 가지며 앞으로는 창작자가 아닌 이용자보호라는 측면에서 지적재산권과 인권과의 관계가 더 많이 연구되어야 할 것이다.
