Our society has been raising the issue of the education gap between cities and rural areas in relation to social polarization. And it has tried to establish the legal basis for bridging the education gap between cities and farming and fishing communities to promote balanced regional development and to strengthen national competitiveness. However, when we look at the current legal basis, there are still limits to the regulations that can support rural students and teachers and that can foster rural schools and areas. Therefore, there are legal issues to be improved to close the education gap between the urban and the rural areas as follows. First, compensation measures are needed to effectively ensure the education rights of the rural students. Second, it is necessary to establish separate standard quotas for proper placement of teachers in rural areas and to strengthen the treatment of the rural teachers to reinforce their working motivation. Third, it is essential to build up a foundation where the rural schools can develop and operate specialization programs themselves. Fourth, the administrative and financial support obligations of the national and local governments to the rural areas should be strengthened. Last but not least, the enactment of a special law that can comprehensively support the rural education can be considered.

우리 사회는 그동안 사회양극화와 관련해 도시와 농어촌 간의 교육격차 문제를 제기해 왔다. 그리고 도시와 농어촌 간의 교육격차를 해소하기 위한 법적 근거를 마련함으로써 지역의 균형발전과 국가경쟁력의 강화를 도모하고자 하였다. 그러나 현행 법적 근거를 살펴보면 학생과 교원에 대해 지원할 수 있는 규정이 미비하거나 농어촌 학교와 지역을 육성할 수 있는 규정이 미흡한 한계가 있다. 따라서 이러한 한계를 해소하기 위해서는 다음과 같은 법적 보완이 필요하다. 첫째, 농어촌 학생의 교육권을 실질적으로 보장할 수 있는 보상 조치가 필요하다. 둘째, 농어촌 교원의 적절한 배치를 위한 별도의 정원 기준을 마련하고, 농어촌 교원의 근무 동기를 강화할 수 있는 처우를 강화해야 한다. 셋째, 농어촌 학교가 특성화 프로그램을 개발ㆍ운영할 수 있는 토대를 마련해야 한다. 넷째, 농어촌 지역에 대한 국가와 지방자치단체의 행ㆍ재정적 지원 책무를 강화해야 한다. 다섯째, 농어촌 교육을 종합적으로 지원할 수 있는 특별법 제정이 검토돼야 한다.
