This paper aims to elucidate the unique value of legal ideas as a separate discipline, to search and solve the major hurdles to its realization. Legal ideas as one of branches of philosophy should answer the fundamental questions of the nature and intelligibility of reality of law. And the notion of intelligibility in this dimension differs from the intelligibility of any given system of positive laws as a particular things. The study of legal ideas is itself an activity of making law intelligible, and has the unique value of its own therein. Philosophical inquiry of legal ideas, however, should be autonomous, rather than parasitic on the legal science, and at the same time be embedded in particular context. In this respect, this paper suggests that the study of legal ideas should be carried out not only inside the boundary of classical texts, but also on the stage of the overall system of positive laws as particular things. This paper calls this alternative to the study of legal ideas the so-called localization of legal ideas.

이 글의 주제는 ‘법사상(legal ideas)’의 연구와 교육에 관한 것이다. 이들이 과연 어떠한 가치를 지닐 수 있는지, 그러한 가치의 실현에 장애가 되고 있는 문제점은 무엇인지, 그 문제점을 해결하기 위한 대안은 있는지 등이 바로 그것이다. 사실상 ‘법철학(philosophy of law)’과 구별해 볼 것도 없는 면에서, 법사상은 ‘법의 실재에 대한 이해’의 차원에서 제기되는 법의 이해가능성 문제를 다룰 것이며, 특히 법학자 및 실무 법조인이 추구하고 전달하는 종류의 이해에 관하여 탐구할 것이다. 요컨대, 법사상의 연구는 그것을 통해서 ‘법을 이해가능한 것으로 만드는(making law intelligible)’ 활동이며, 바로 그 지점에서 독특한 연구 가치를 지닌다고 말할 수 있다. 주의할 점은 개별적 철학 분과로서 법사상의 탐구 활동이 실정법학과의 관계에서 자족적(autonomous)이면서도 동시에 맥락적으로(contextually) 존재해야 한다는 사실이다. 특히 후자와 관련해서 말할 수 있는 것은, 법사상의 연구를 통해서 법을 이해가능한 것으로 만드는 활동이 구체적으로 어떻게 수행되어야 할지에 대하여 하나의 실용적 단서를 제공한다는 점이다. 그것은 법과 판례 중에 숨어 있는 법사상의 흔적을 발굴하는 작업 형태를 취하라는 것, 다시 말해서 법사상을 고전 텍스트의 닫힌 영역 안에서 다루던 것으로부터 벗어나, 법질서의 전체 영역을 무대로 하여 그 의미의 연결고리를 찾아 나서라는 것이다. 이렇게 볼 때 법사상의 연구가 이른바 지역화(localization)에 들어서는 것이야말로 “관념(ideas)이란 그 맥락(context)으로부터 찢어서 떼어낼 수 있는 것이 아니”라는 전제에 부합하는 길일 수 있다.
