The revision of the Criminal Procedure Law of China in 2013, the ninth-revision of the criminal law took effect in November 2015, the legislation of the anti - terrorism law was completed, and it took effect from January 1, 2016. As a result, China has expanded the scope of pursuing criminal responsibilities against terrorism in the criminal law system, while on the other hand it has completed its anti-terrorism law, which is the basis of independent administrative responsibility and counter-terrorism practical activities, China has completed the legal system on anti - terrorism in the form of legislation that crosses the provisions of the Criminal Law or allows it to be combined and applied. In this research, I wanted to grasp how problems such as protection of Chinese legalism and human rights, criminal responsibility theory, the principle of proportionality etc are implemented by criminal entity law and procedural law. A study on how the regulation of anti-terrorism law is realized in the China Criminal Law system which is all in constituent requirements of the content of criminal penalty. I hope that it will be a starting point for discussion and as a reference for improvement of South Korea's counter-terrorism regulation legislation.

중국의 형사소송법이 2013년부터, 형법의 9차 개정이 2015년 11월부터 시행되었고, 반테러리즘법도 입법이 완성되어 2016년 1월 1일부터 효력이 발휘되었다. 이로써 중국은 형사 실체법 체계에서는 테러리즘에 대한 형사책임을 추궁하는 범위를 확장하고, 다른 한편으로 독자적인 행정책임과 대테러실무활동의 근거가 되는 반테러리즘법을 완성하여 테러활동에 관하여 형법과 형사소송법의 규정과 교차되거나 연계되어 적용할 수 있도록 하는 입법적 형태로 반테러리즘에 관한 법률 시스템을 완성하였다. 본 연구는 중국에서 법치주의와 인권보호원리, 책임주의, 비례원칙 등의 대테러리즘 원리가 형사실체법과 절차법에서 어떻게 구현되고 어떤 문제점이 있는지를 파악하고자 하였다. 형사처벌 내용의 구성요건을 모두 통일된 형법전에 담고 있는 중국 형사법 체계에서 반테러리즘법의 규제가 어떻게 실현되고 있는가 하는 연구는 최근 테러방지법을 입법한 우리나라에게도 다양한 시사점을 제시하는 것이었다. 최근 중국의 대테러활동에 관한 제도적 의의와 형사법적 연계에 관한 본 연구가 앞으로 우리나라의 대테러 규제 관련 입법 개선에 참고와 논의의 시작점이 될 수 있기를 바란다.
