The Korea Coast Guard was dismantled by the amendment of the National Government Organization Act and reshuffled to the Korea Coast Guard under the Ministry of Public Safety. The reformed Korea Coast Guard is responsible for investigation into only 'the incidents occurred on the sea' among the maritime incidents which the former Korea Coast Guard took full charge of, and the National Police Agency investigates the rest of the maritime incidents. However, since the meaning and scope of 'the incidents occurred on the sea' has not been clarified by the law, the investigations into the maritime incidents are open to troubles. First, with the unclarified scope of work of the headquarters of the Korea Coast Guard and the National Police Agency on the maritime incidents, the possible investigative vacuum or overlap may cause problems, leading to unnecessary business confusion, excessive expenses and national pain. Therefore, this study aimed to clearly set the scope of work of the headquarters of the Korea Coast Guard and the National Police Agency for the investigation into the maritime incidents by identifying the maritime incidents and the meaning of 'the incidents occurred on the sea', and to seek the direction to develop the investigation into the maritime incidents by examining the appropriateness of the organization and personnel of the headquarters in charge of the maritime incidents given the scope of work for the investigation.

해양경찰청은 정부조직법의 개정에 의해 해체되고, 신설된 국민안전처 소속 해양경비안전본부로 개편되었다. 그동안 해양경찰청이 전담하였던 해상사건의 수사 가운데 ‘해상에서 발생한 사건’에 대해서만 해양경비안전본부가 수사를 담당하고, 그 이외의 해상사건에 대해서는 경찰청이 수사를 담당하는 것으로 되었다. 그런데 ‘해상에서 발생한 사건’의 의미와 범위가 법령에 명확히 규정되어 있지 않기 때문에 해상사건에 대한 수사에서 문제가 발생할 소지가 있다. 우선 해상사건에 대한 해경본부와 경찰청의 수사 직무 범위가 명확히 구분되지 않기 때문에 수사의 공백 또는 수사의 중복이 문제될 수 있으며, 이러한 문제로 인하여 다시금 불필요한 업무혼선, 과비용, 국민고통 등이 야기될 수 있다. 따라서 이 연구는 해상사건과 ‘해상에서 발생한 사건’의 의미를 규명하여 해상사건에 대한 해경본부와 경찰청의 수사 직무 범위를 명확히 설정하고, 그러한 수사 직무 범위에 비추어 해상사건의 수사를 담당하는 해경본부의 조직과 인력구성이 적절한지에 대해 검토함으로써 해상사건에 대한 수사의 발전방향을 모색하기 위한 것이다.
