Despite the public awareness which has increased on cultural heritage since Sungnyemun Gate(Seoul) fire accident, there has been relatively little policy act on cultural heritage disaster in Korea. In particular, if cultural heritage is damaged, it takes a lot of time and budget to restore it. And the frequency of cultural disaster has been constantly increasing since the 2000s. In this context, the purpose of this study is to investigate of Legislation necessity of cultural heritage disaster. And this study establishes a conceptual framework based on a review of the existing literature and various cultural heritage statistics.

숭례문 화재 사건 이후로 국민의 문화재 중요성에 대한 인식이 높아졌다. 특히 문화재는 한번 훼손되 면 다시 복구하기까지는 물리적 시간이나 막대한 재원이 소요되며, 2000년대 이후로 문화재 재난의 빈 도는 끊임없이 증가하고 있는 상황이다. 하지만 아직까지는 문화재 방재에 있어서 법정책적 기반이나 체계가 미흡한 것이 현실이다. 본 연구에서는 이러한 맥락에서 최근 들어 급증하고 있는 문화재 재난 발생에 대한 대응책으로서 문화재 방재 법률의 기반 조성 필요성에 대해 논의하였다.
