This essay is focused on refuting Lisska’s criticism on theistic natural law ethics out of three positions of the contemporary Thomistic natural law theory. For this, I show the invalidity of his argument by pointing out these: confusion of epistemological problem with metaphysical; devaluation of eternal law as the second order problem without any sufficient ground; misunderstanding of the distinction between metaphysics and theology in Aquinas; failure to notice the importance of Imago Dei and the connection between obligation and God; blockedness of Lisska’s three ways to escape from theological pitfalls; invalidity of argument for independence of essence from God; confusion of knowledge with existence in dealing with eternal law; insufficiency of five necessary conditions in Aquinas’s natural law theory suggested by Lisska. From these, we may understand that Lisska wrongly supposes the reconstruction of the whole Thomistic natural law theory only with Aristotelian teleological metaphysics and that Lisska tries to exclude God and the eternal law from Thomistic natural law theory without any sufficient examination of Aquinas’ own texts.

현대 토마스주의 자연법 이론의 세 가지 유형 중에서 유신론적 자연법주의에 대해 리스카가 비판한 점을 재비판하는 것이 이 글의 목적이다. 이를 위해 필자는 리스카의 논리에 있어 다음과 같은 점들을 지적함으로써 그의 논리가 타당하지 않음을 주장한다. 인식론적 문제를 형이상학적 문제와 혼동했기 때문에 근거 없이 영원법을 제2위의 형이상학적 문제라고 가치 절하한 점; 형이상학과 신학과의 구분에 대한 오해와 신의 모상의 중요성과 의무 이론이 신, 영원법과 직접 연관된다는 사실의 간과; 리스카가 제시한 자연법이 신학적 함정에서 벗어나는 세 방법의 실패; 본질 개념이 신으로부터 독립적이라고 하는 논리의 부당함; 영원법에 대한 지식과 존재의 혼동; 리스카가 제시한 아퀴나스 자연법 이론의 다섯 가지 필요조건의 불충분성. 따라서 리스카는 아리스토텔레스주의 목적론적 형이상학만으로 아퀴나스 자연법 이론 전체를 재구성할 수 있다고 잘못 가정하였고 토마스 텍스트에 대한 충분한 주의 없이 부당하게 신과 영원법을 토마스주의 자연법 이론에서 배제시키려고 한 점을 밝혔다.
