Nowadays most nations are adopting the representative democracy in which representatives instead of the general public decide national policies and opinions. Korea is one of those nations. As criticisms are mounting against the representative entities, however, efforts to bring changes to the representative democracy are being made across the nations. One of such efforts is to search for the way for the general public to participate in the policy-making of a nation. This paper examines how the general public participate in the legislative process in Korea as a way to see how participatory democracy works in Korea. The National Assembly Act provides several ways for the people to participate in the legislative process in Korea. First, advance public notice is made on the home page of the National Assembly before representatives begin deliberation on a bill. People are free to put their opinions on the site, so that representatives may take them into consideration when they deliberate the bill. Second, a committee may hold a public hearing to hear opinions of the interested parties and experts when it examines a bill. Third, any person can make a written petition along with the introduction of a representative, asking the National Assembly to enact a law.

오늘날 대부분의 국가에서는 주권자인 국민이 직접 국가의사나 정책을 결정하지 않고, 국민이 선출한 국민대표들이 국민을 대신하여 국가의사나 정책을 결정하는 대의제 정부형태를 채택하고 있다. 우리나라도 예외는 아니다. 그런데 이러한 대의제 민주주의는 민주주의 내지 국민주권주의를 구현하기 위한 수단적 정치제도이지, 그 자체가 목적이 될 수는 없다. 대의제 민주주의가 주권자인 국민의 의사와 다르게 운영된다면, 민주주의 내지 국민주권주의를 구현하기 위해서 대의제 민주주의에 대한 변화를 모색하지 않을 수 없다. 오늘날 우리나라를 비롯해서 서구 국가에서도 대의제 민주 정치를 담당하고 있는 정치권에 대한 국민의 불신이 고조되는 가운데, 고전적 대의제 이론에 대한 반성과 대의제 이론에 대한 변화를 시도하려는 노력이 나타나고 있다. 대의제 민주주의를 할지라도, 주권자인 국민도 직접 국가의사나 정책의 결정에 참여하는 방안을 논의하기 시작한 것이다. 단순한 논의에 그치지 않고, 실제로 국가의사나 정책의 결정에 국민이 참여하는 방향으로 제도의 개선도 이루어지고 있다. 물론 국가의사 결정에 대한 국민의 참여는 제한적으로 이루어지고 있다.
