This article is related to effects of patent right with its term extended by permit. According to Korean Patent Law Article 89, when any one intends to implement a patented invention, he/she shall obtain a permit or file for registration under other Acts and subordinate statues, and, in cases of an invention prescribed by Presidential Decree, which takes a long time due to activity or safety tests, etc. required for such permit or registration. etc., the term of the relevant patent right may be extended up to five years, during which the relevant invention cannot be implemented. Meanwhile, according to Korean Patent Law Article 95, the effects of a patent right, the term of which has been extended, shall not extend to any other acts except the working of the patented invention with respect to such products for which permission, etc. was the basis for registering the extension. Thirty years have passed since patent term extension registration system was implemented in Korea. However, critical review or study of this system was not enough. I have studied the effects of patent right with its term extended by permit and suggest rational interpretation of current law and propose legislative measures.

특허권 존속기간 연장등록 제도는 1987년에 우리나라가 물질특허제도를 도입하면서 함께 도입한 제도이다. 특허법 제89조에 따르면, 특허발명을 실시하기 위하여 다른 법령에 따라 허가를 받거나 등록 등을 하여야 하고, 그 허가 또는 등록 등을 위하여 필요한 유효성․안전성 등의 시험으로 인하여 장기간이 소요되는 대통령령으로 정하는 발명인 경우에는 그 실시할 수 없었던 기간에 대하여 5년의 기간까지 그 특허권의 존속기간을 한 차례만 연장할 수 있다. 한편 동법 제95조에 따르면, 특허권의 존속기간이 연장된 특허권의 효력은 그 연장등록의 이유가 된 허가등의 대상물건(그 허가등에 있어 물건에 대하여 특정의 용도가 정하여져 있는 경우에는 그 용도에 사용되는 물건)에 관한 그 특허발명의 실시 행위에만 미친다. 특허권 존속기간 연장등록 제도를 시행한지 30년이 지났지만 지금까지 해당 제도에 대한 비판적 고찰이나 연구가 충분하지 않았다. 본 논문에서는 존속기간이 연장된 특허권의 효력범위에 대한 연구를 진행하여 현행법의 합리적인 해석론 및 입법론을 제안하였다.
