The Conciliation, Arbitration and Compromise have been often used for the resolution of commercial disputes, particularly in the context of international commercial transactions. However, as the international commercial environment has changed owing to the introduction of Internet technology, various types of disputes have emerged. It is no longer appropriate to apply current rules to new types of disputes. To copy with this issue, Online Dispute Resolutions(ODRs) have emerged. Firstly, the study looks into characteristics of online dispute resolutions compared to traditional dispute resolution methods. Secondly, the study examines characteristics of ODRs as a way of dispute resolution in connection with the applicability of online and offline disputes. Thirdly, the study reviews rules of ODRs especially online arbitration such as the UNCITRAL Model Law on Online Dispute Resolutions as well as the China International Economic and Trade Arbitration Commission Online Arbitration Rules(CIETAC Online Arbitration Rules) adopted in 2009. Accordingly, the study looks into ways how online arbitration proceedings could ensure recognition and enforceability of arbitral awards in the domestic courts in the context of application of the New York Convention. Legal issues of online arbitration proceedings could not be easily resolved in a short period of time; yet, this study confirms that those issues are no longer obstacles in the growth and advancement of online arbitrations in the international commercial transactions.

국제상거래에서 발생하는 분쟁의 해결을 위해 다양한 방법이 이용되어 왔다. 그러나 전통적 국제상거래 환경은 인터넷 기술의 도입으로 현저히 바뀌었고, 분쟁의 유형 또한 매우 다양해짐으로 인해 그 새로운 해결책이 필요한 시점이다. 이에따라 공간이라는 물리적 개념을 초월하여, 온라인 네트워크 기술을 이용한 커뮤니 케이션이 가능해짐에 따라 가상공간 및 실제생활에서 발생된 분 쟁을 이와 같은 첨단 기술을 이용하여 가상공간 자체에서 해결하 는 많은 방법들이 고안되어, 서비스가 이루어지고 있다. 이러한 서 비스들을 정의하는 것이 바로 온라인 분쟁해결방법(ODR)이며, 이 는 새로운 유형의 분쟁을 가상공간에서 보다 신속하고 효율적으 로 대응하기 위한 것이다. 이러한 서비스 유형으로는 온라인 조정, 중재, 화해, 알선 및 자동화 협상 그리고 온라인 소비자불만해결 등이 있고, 이는 전자상거래, 도메인 분쟁 및 보험 분쟁 등에서 활 발히 이용되고 있다. 게다가 분쟁의 종국적 해결을 위해 구속력 있는 판단을 위한 온라인 분쟁해결방법은 바로 온라인 중재일 것 이다. 실제로 미국, 싱가폴, 중국 등 국외에서는 온라인 중재를 서 비스하고 있고, 이런 서비스를 위해 유엔국제상거래법위원회 및 중국 국제경제무역중재위원회에서는 온라인 중재규칙을 제정하여 발표함으로써 많은 상거래에 그들의 온라인 중재규칙을 적용하고, 자신들의 중재기관을 이용해 주기를 홍보하고 있는 실정이다. 따 라서 이러한 온라인 분쟁해결방법의 활용과 그 현황을 검토해 볼 필요가 있다.
