In order to solve the welfare problems of elderly people in an aging society and to create a donation culture, it has been argued to enact the Charitable Gift Annuities(CGA), which is a type of planned donation in America. There is no discussion about the origin of the system(the characteristics of the American society) and the relationship with the current system that may arise during the introduction of the system. Here are some points to consider in future legislation on the Charitable Gift Annuities(CGA). First, in relation to the legal nature of Charitable Gift Annuities contract, the US sees it as a bargain sale rather than as a gift, but in our case, it can be seen as a Auflagenschenkung(conditional gift). It is necessary to consider this in the revision of the tax laws and related laws. Second, Legislative decision will be necessary considering the relation with the Forced Share. Third, under current legislation, it is necessary to consider systems (charity trust and insurance system) designed for purposes similar to the Charitable Gift Annuities.

최근 고령화 사회의 노인복지문제를 해결하고 기부문화를 조성하자는 차원에서 미국법상 계획기부의 한 형태인 기부연금제도를 도입하자는 주장이 제기되었다. 종래의 논의는 도입의 필요성이라는 당위(Sollen)에 초점이 맞추어져 있을 뿐, 그 제도의 기원(미국이라는 사회의 특징) 및 도입시 발생할 수 있는 현행제도와의 관계에 대해서는 아무런 논의가 없었다. 이에 본고에서는 이 제도의 기원 등을 확인하였고, 이 제도의 도입을 위한 선결문제로서 기부연금계약의 법적성질과 유류분제도와의 관계를 고려하였다. 향후 기부연금제도에 관한 법안들이 고려해야 할 몇 가지 사항을 제시하면 다음과 같다. 첫째, 기부연금계약의 법적성질과 관련하여 미국은 기부연금계약을 증여가 아닌 Sale(교환 또는 매매)로 보지만 우리의 경우에는 부담부 증여(또는 증여와 종신정기금계약이 혼합된 계약)로 볼 여지가 다분하다는 점에서 세법 및 관련법 재‧개정에 있어 이를 고려하여야 할 것이다. 둘째, 미국은 혼인계약으로 유류분을 사전에 포기할 수 있다는 점, 배우자이외에 자녀에게 유류분권이 인정되지 않는다는 점, 특유재산에 대하여 유언의 자유가 보장된다는 점 등에서 기부연금제도와 유류분제도의 관계가 문제되지 않는다. 반면에 우리의 경우에는 유류분권의 사전포기가 인정되지 않는다는 점, 자녀에게도 유류분이 인정된다(민법 제112조)는 점에서 유류분제도와의 관계를 고려한 입법적 결단이 필요하다. 셋째, 현행법상 기부연금제도와 유사한 목적을 위해 마련된 제도 등(공익신탁제도 및 보험제도)이 있다면, 현행제도를 통해서는 달성할 수 없고 기부연금제도만을 통해서 달성할 수 있는 경우에 한하여 이를 도입해야 할 것이다(기부연금제도 도입의 보충성).
