A professional investigator certification system is a system that requires the execution of professional investigator certification courses provided by the Korea Police Investigation Academy. This system refers to a series of courses where investigation progress is given by evaluating certain qualities for subjects who went through the selection process of investigation polices and the investigator training course and advanced to actual front sites and acquired techniques from practice while the acquisition of a qualification namely a professional investigator is given to those who completed professional investigation training performed on subjects that have progressed with investigation at the Korea Police Investigation Academy through their position management of at least five years(Police White Paper, 2012: 299). The purpose of a professional investigator certification system carried out by the Korea Police Investigation Academy is to establish the reasonableness of acknowledging commitment of crime following the principle of free evaluation of evidence by the judiciary and the principle of adjudication based on evidence by the investigative agencyunder the current system placing significance on trials in terms of the procedure of criminal cases. Also, with the execution of laws onparticipation of citizens in criminal cases, jury trials where citizens participate in are being held, and individual juries are allowed to participate in discussions. They have become to stand as the principal agents of determining the probative power submitted by the investigative agency, which in other words, it becomes more important to scientifically prove through scientific investigation the definite proof of guilt, as they need to be provided to the ordinary people that are not judges(Noh, Myeongsun, 2009: 152). Therefore, it is required the quality improvement of professional investigators or the cultivation of investigators for professionalism in the process of investigation. In this paper, for the plans to invigorate the professional investigator certification system currently progressed by the Korea Police Investigation Academy, detailed improvement plans are recommended for influential elements where the elements are classified into: security environment element; professional knowledge element; and educational environment element. Finally, the study finishes by also recommending the plan to improve the issue of exclusive evidence submission by professional institutions such as the current National Forensic Service.

전문수사관 인증제란 일선현장에서 수사기술을 수행·습득한 자를 대상으로 일정자격을 심사하 여 수사경과를 부여하며, 5년 이상 보직관리를 통해 경찰청 산하 경찰수사연수원에서 수사경과자 를 대상으로 전문수사교육을 받아 수료한 자로 하여금 전문수사관 인증이라는 자격을 부여하는 과정을 말한다. 이 제도는 현재 형사절차상 공판중심주의 제도 아래에서 수사기관이 증거재판주 의와 법관의 자유심증주의에 따른 범죄사실인정의 합리성을 확보하기 위한 목적이 있다. 이러한 연구목적을 달성하기 위하여 문헌연구방식을 중심으로 5대범죄의 검거 등 공식통계를 분석하여 관련 법률과 경찰, 검찰, 국내의 형사소송법상 이론 등을 접목하여 연구를 진행하였다. 연구범위 는 전문수사관인증을 위한 전문지식적 요소에 한정하며, 치안환경적·교육환경적 영향 요소의 개 선 방안에 관하여는 한정된 지면관계상 차후에 언급하기로 함을 미리 밝힌다. 더욱이「국민의 형사재판참여에관한법률」에 따른 배심재판의 시행은 전문수사관 인증제의 필 요성이 더욱 배가된다. 이유는 개별적인 배심원도 형사재판의 평의에 참여하여 수사기관이 제시 한 증명력 판단의 주체가 되기도 하고, 법관이 아닌 배심원들에게 유죄의 확증을 가지게 하기 위 해서 과학수사를 통한 과학적인 입증의 중요성은 더해가고 있는 실정이기 때문이다. 따라서 형사 절차에서 전문성을 갖춘 수사관을 양성하기 위해서는 전문수사관의 질적 향상을 필요로 하며 이 러한 의미에서 이 연구의 필요성이 제기된다. 이 연구에서는 전문수사관 인증제의 활성화를 위하여 전문지식적 요소의 세부적 개선 방안으로 수사절차상 사실인정의 과학적 접근에 따른 전문화 유도 방안, 공판중심주의에 대비한 과학적 전문 성 인증에 의한 법관의 자유심증의 형성 방안, 과학적 수사 기법 활용에 따른 전문수사관 인증제의 활성화 방안, 디지털 증거에 대한 전문성 확보 방안, 마약과 혈흔분석 대상으로 체액(혈액)수집의 특 수성을 감안한 수집과 분석에 대한 전문성 함양 방안을 들었다. 부수적으로 선진 외국처럼 수사의 전문성 향상을 위하여 관련 있는 유관기관의 종사자들과 상호 협력하여 과학적 연대시스템도 필요 하며, 범죄학 또는 의학 등 유관 교육기관과의 긴밀한 상호 교류와 협력도 필요로 함을 언급하였다. 끝으로 현대사회에서 증거는 간접증거 비율이 높아 수사과정상 객관적이고 과학적인 전문성이 절 대적으로 요구되는 만큼 이에 걸 맞는 수사전문가의 양성이 요구되며, 선진기법의 수사방식도 필요 로 함을 소개하며 연구를 마친다.
