The mass growth of the private security industry have followed the fall of conventional command and control style of regulation and the rise of compliance-based management as an regulatory alternatives since the late '90s in the Western world. The restorative regulatory model, which aims to curb government excesses, have since been widely embraced as a theory and practical strategy in both academia and authority. The restorative-oriented regulation differs in its approaches to regulatory reform in that this model emphasizes building a culture of compliance and enhancing regulatees’ capabilities over retribution. The core elements of this model include strategic networks, partnerships and proactive prevention, as opposed to piecemeal, prescriptive and reactive approach to specific problems. In recent years, there has been a growing body of research that explore possible strategic add-on options to facilitate compliance and enforcement. This has resulted in internationally-recognized and agreed standards for compliance management framework. With these in mind, this article provides a detailed review of the best-practice model progressed to date in Australia, US, and UK for managing risk and compliance, and evaluate areas of possible improvement in regulation relative to South Korea. Overall, this study has identified three key features that warrant policy attention: ① the four-phase model of compliance enforcement pyramid that provides a mechanisms for redress, thereby minimizing the undesired side effects of escalating sanctions, ② the wider application of real-time checking, ③ the shock probation strategy that send a strong message, by giving the violators a ‘taste’ of sanctions at the apex. The overall lessons learnt from the case studies were taken into account in determining the following checks and balances that would provide the ideal setting for the best-practice arrangement: ① a set of well-defined indicators, ② a customized strategy for inducing compliance, ③ a centralized specialist research institute.

민간경비산업의 양적팽창이 가속화됨에 따라 직접적인 명령･통제 위주의 전통적 규제방식이 한계를 드러내게 되었고, 이를 극복하기 위한 대안으로 서구에서는 규제순응 제고를 위한 다양한 실천전략들에 대한 논의가 90년대 말부터 진전되기 시작했다. 규제순응 확보를 지향하는 회복적 규제 담론은 명령지시 성격 규제의 대표적 단점인 과잉규제를 제고하기 위한 취지에서 부상하였고, 이후 학계와 실무영역에서 다각적인 연구와 실천이 진전돼 왔다. 회복적 규제개혁은 처벌적 태도를 취하는 경직된 규제접근방식과 달리, 피규제집단으로부터 협력과 수용을 이끌어내어 규제정책의 순응확보전략을 제고하는 것에 초점을 맞춘다. 회복적 규제의 핵심은 ‘단절과 갈등관계’가 아닌 ‘협력관계에 기초한 우호적 파트너쉽과 연결’, ‘응보적 사후제재’보다는 ‘예방진단체계의 구축과 사전억지’에 있다. 오늘날 회복적 규제담론은 대안의 의미를 넘어 국제사회에서 광범위한 지지를 얻고 있으며, 더불어 창의적 응용전략의 개발 또한 활발하다. 이에 본 연구에서는 규제혁신에 대한 실증사례를 호주, 미국, 영국을 중심으로 고찰하여 국내제도에 참고할만한 시사점을 도출하였다. 사례연구 결과, 회복지향적 경비산업 운영기법은 ① 네 단계의 피라미드형 개입을 통한 규제순응 문제해결 관리구조, ② 선제적 리스크관리 지원을 위한 실시간(real-time) 모니터링 인프라 구축, ③ 준수의무 위반행위에 대한 적절한 긴장과 충격요법 방식의 제재를 특징으로 하였다. 이상의 시사점을 바탕으로 본 연구는 최종적으로 ① 보다 직관적으로 도식화된 규제원칙의 확립, ② 리스크 평가 정도에 따른 맞춤형 전략구사의 필요성, ③ 통합체로서 기능할 수 있는 전담 민간경비연구기관의 구축의 필요성에 대한 시사점을 제시하였다.
