The participation of Third-Party Intermediary(TPI) such as family, friends, and the official mediators into the process of crisis negotiation was not recommended in early days of 1980. Because the use of TPI did result in a disaster. But the crisis negotiation teams have used TPI for successful resolution of crisis without any consideration. The direct communication between the subject and the TPIs remain uncertain and counterproductive. The uncontrolled TPIs often has led to tragic consequences for all involve. So I suggest the concept of the “controlled TPI”. The controlled TPI means that the use of he/she under the should be identified as appropriately, and be communicated under the tactics of crisis negotiation team. The controlled TPI will product the positive consequences of crisis incidents. Through the guideline of controlled TPI, the appropriate use of TPI by the Police could be analysed on case study. The negotiators should provide TPIs with complete instructions, stressing restrictions and precautions, regarding the role TPIs play in negotiation process. First, negotiators determine carefully if such intervention will help the operation and identify the risks and benefits of using untrained individuals who may be emotionally involved with the subjects. Particularly, negotiators must examine the reasons that the subjects want to talk with the requested individuals and vice versa. Also, to effectively use TPIs,negotiators must choose the appropriate method of contacting subjects in crisis negotiations.

위기협상의 발전 초기에는 위기자의 감정을 자극할 수 있는 위험성이 부각되어 가족, 친구 등 제3중재인의 협상참여가 엄격히 금지하였다. 그럼에도 불구하고 위기협상 현장에서는 여러 가지 현실적인 이유로 경찰은 제3중재인을 협상에 직접 참여시켜왔다. 최근의 위기협상전문가들은 제3중재인의 활용이 필요하기도 하지만, 활용여부, 시기, 그리고 대화방법에 대한 신중한 검토가 있어야 한다고 지적하고 있다. 이에 본고에서는 위기협상의 통합적인 정보전달 모델을 통하여 직접적인 위기자와 제3 중재인의 의사소통이 아니라, 경찰의 협상전략에 통합된 제3중재인을 “통제된 제3중재인”으로 개념지우고, 그 활용에 대한 가이드라인을 제시하였다. “통제된 제3중재인” 은 위기자와 경찰 외의 개인이지만, 개입하기 전에 상황에 대한 충분한 인식, 자신의역할에 대한 한계, 그리고 경찰의 지시에 대한 협력필요성에 대하여 충분히 알고 있어야 한다. 대화방법 측면에서도 경찰의 적절한 통제가 가능하고 제3중재인에게 위험이 없어야 한다. 이러한 가이드라인을 통하여 현장에서의 제3중재인의 활용에 대한적절성을 검토하고자 사례분석을 하였다. 2015.1.13. 발생한 안산인질사건에서 일부학자의 의견을 반영한 언론에서는 제3중재인의 활용 자체가 잘못되었다는 비판적인입장을 보였다. 하지만 동 사안에서는 부인이 경찰도착 전부터 이미 인질범과 통화를하고 있어서, 제3중재인의 활용여부보다는 경찰의 협상주도권 확보가 특히 문제되었고, 인질범의 인질을 위협하는 강력한 저항을 고려했을 때, 경찰의 협상전략 변화로서의 제3중재인 활용은 적절하였다. 특히 부인은 휴대폰의 스피커폰 기능을 이용하여대화내용을 공유할 수 있어서 경찰의 통제 하에 협상에 참여하는 “통제된 제3중재인” 으로서 경찰의 지시에 적극적으로 협력하였고, 경찰이 원하는 시기에 협상을 중지할수 있었으며, 제3중재인의 안전에 위험도 없어서 경찰의 제3중재인의 활용이 적절하였다고 판단된다. 따라서 제3중재인의 활용여부보다는 통제된 상황인가가 더욱 중요한 요소로 평가되어야 한다. 제3중재인의 활용은 과거에는 금기시 되었지만 위기상황의 평화적인 해결을 위해서 필요한 경우에는 사전에 치밀한 조사와 위험요소를 검토하여 적절한 시기에 투입되고, 대화내용을 경찰을 통제할 수 있다면 적절한 제3중재인의 개입이라고 생각해야 한다.
